In the matter of "The Debtors and Creditors Act, 1862";

And in the matter of John McIntosh, late of Wellington, Trader.

IN THE SUPREME COURT OF NEW ZEALAND, MIDDLE DISTRICT.

TUESDAY, 15th day of December, 1863, upon hearing Mr. Hart and Mr. Izard of Counsel for the said John McIntosh and Mr. Borlase of Counsel for George Crawford and Walter Turnbull, it is ordered that a meeting of the creditors of the said John McIntosh be held on Wednesday the sixth day of January, 1864, at two o'clock in the afternoon, in the Grand Jury Room in the Supreme Court House, Wellington, for the election of persons to act as Trustees of the estate and effects of the said John McIntosh, and to consider the several questions, matters and things relating to the estate and affairs of the said John McIntosh, and the measures desirable for winding up his estate; and to make such recommendations to the Court touching the said several questions, matters and things as shall be agreed upon at such meeting.

IN THE SUPREME COURT OF NEW ZEALAND, MIDDLE DISTRICT.

ON TUESDAY, the Fifteenth day of December, 1863, on reading this Petition and the Affidavits of James Carter and Walter Woods Johnston, sworn respectively the 26th day of November and 25th day of November last, and hearing what was alleged by Mr. Hart and Mr. Izard of Counsel for the Petitioners, by Mr. Allen of Counsel for the said John McIntosh, and Mr. Borlase of Counsel for Walter Turnbull and George Crawford. It is ordered that the said Petition be heard on Friday, the 15th day of January next, at eleven o'clock in the forenoon at the Supreme Court House, Wellington, and the said John McIntosh do attend at the time and place aforesaid to be examined touching his Estate and Effects, and in the meantime and until such hearing or until the further order of this Court to the contrary, it is ordered that the estate and effects of the said John McIntosh be and the same are hereby sequestrated, and it is further ordered that (without prejudice, to any question relative to the validity of the Deed of the twentieth day of October, 1863), in the Petition mentioned, the Estate and Effects of the said John McIntosh, shall be taken and held by George Crawford of Wellington, merchant, and Walter Turnbull, of Wellington, merchant, in such manner for such time, and otherwise as this Court shall from time to time direct, subject to such further order of the Court as may be made in pursuance of the provisions of the said Act.

IN THE SUPREME COURT OF NEW ZEALAND, MIDDLE DISTRICT.

ON TUESDAY, the 15th day of December, 1863, upon hearing the Petition herein read and Mr. Hart of Counsel for John Martin, the detaining Creditor, and the Petitioner consenting, it is ordered that until the 15th day of January, one thousand eight hundred and sixty-four, or the further order of this Court to the contrary the person and estate of the said John Greaves be protected from arrest, execution, or other legal process, and that the person of the said John Greaves shall also be protected from further detention, provided that the said John Greaves do attend at the hearing of the said Petition, and provided that the Petitioner shall be liable to be remanded into custody upon the execution upon which he is detained on the further order of this Court.
