Education Ordinance 1867




VI. Payment at a minimum rate of school fees may be recom-
mended by the Board for the Education of children whose
parents or guardians are unable to educate them, a certificate
of such inability to be given to the satisfaction of the Board.

  1. The Board shall have power to appoint Teachers, enter into Education Board
    agreements with them and remove them when requisite, to make, alter to appoint
    and amend, from time to time, general regulations, regulating and de-
    fining the kind of Education, the hours of instruction, the class-books
    to be used, and the good order and discipline to be maintained in Schools,
    and also the condition, the furnishing, and other appurtenances of the
    School-houses.

  2. All rents and monies accruing from School or Educational Rents, &c., pay-
    able to Provin-
    cial Treasurer.
    Reserves shall be payable to the Provincial Treasurer and the Board may, and is hereby
    authorised to appropriate such revenues in the same
    way and for the like purposes to which the grants to Schools out of sums
    voted by the Provincial Council is to be devoted, under the provisions of
    this Ordinance, and out of such monies, the Board may from time to time
    grant sums for the erection of Schools and repairs of School Buildings,
    and for the establishment of School Libraries.

  3. All Educational Reserves now existing, or which may be Educational
    Reserve vested
    in Education
    created, together with all School buildings erected thereon, shall for the Board.
    purposes of this Ordinance, be dealt with by the Board and all powers
    having reference thereto vested in the Education Board under the provi-
    sions of the “Education Endowments Ordinance 1862,” and the
    “Education Endowments (Rural) Ordinance, 1863,” shall be deemed to
    be vested in the Education Board.

  4. Whenever it is proposed to establish and erect any new Schools Superintendent &
    or to give grants in aid to any such new Schools, or to any School Education
    already established, the Education Board shall appoint District School Board
    to pro-
    claim: Educa-
    Committees consisting of five persons who shall be nominated by the tional districts.
    heads of families and contributors to the School-fund within such district.
    And the districts already proclaimed or which may be proclaimed
    Educational Districts by the Superintendent, shall be deemed to be the
    Educational Districts under this Ordinance, provided always, that the Superin-
    tendent may upon the recommendation of the Education Board proclaim
    new districts, and from time to time subdivide or alter the boundaries of
    Educational Districts.

  5. The Education Board shall have power to appoint when neces- nunc a tio n
    sary a Secretary and Inspector, and to discharge the same officer Board to appoint
    when requisite, whose duties shall be to keep a record of all matters Secretary and
    connected with the fulfilment of the duties of the board, and also to Inspector.
    periodically inspect all Public Schools under the control of and receiving
    grants in aid from the Board.
