PROCLAMATION.

Declaring the “Thistle Ordinance, 1862,” to be in operation within a certain District in the Province of Otago.

By His Honor James Macandrew, Superintendent of the Province of Otago.

WHEREAS by an Ordinance made by the Superintendent of the Province of Southland, with the advice and consent of the Provincial Council thereof, entitled the “Thistle Ordinance, 1862,” it was enacted that it should be lawful for the Superintendent from time to time by Proclamation in the Provincial Government Gazette, to declare that the said Ordinance should come into operation within any district, and thereby to define the limits of the district. And Whereas by “The Otago and Southland Union Act, 1870,” it was enacted that in every Ordinance of the Superintendent and Provincial Council of the Province of Southland the terms “Superintendent” and “Provincial Government Gazette” should, upon the coming into operation of the said Act, be construed as and should mean respectively the Superintendent for the time being of the Province of Otago (therein called the “new Province”), and the Government Gazette of the said Province of Otago.

Now therefore, I, James Macandrew, Superintendent of the said Province of Otago, do hereby by virtue of all the powers enabling me in this behalf, proclaim and declare that the said “Thistle Ordinance, 1862,” shall come into operation on and after this day within the District hereinafter described, as the limits of the said District are defined and described in the Schedule hereto.

Schedule.

All that parcel of land in the Province of Otago bounded towards the North by the northern boundaries of the Aparima and Oreti Hundreds; towards the East by the Oreti River; towards the South by the Ocean; and towards the West by the western boundaries of the Jacob’s River and Aparima Hundreds.

Given under my hand, and issued under the public seal of the Province of Otago, at Dunedin, this twenty-fourth day of September, in the year one thousand eight hundred and seventy four.

PROCLAMATION.

Extending Time within which certain Lands in certain Hundreds in the Province of Otago shall be open for Sale.

By His Honor James Macandrew, Esquire, Superintendent of the Province of Otago.

WHEREAS the Lands hereinafter mentioned and described, being the lands within the Hundreds hereinafter named, have, by proclamation by His Excellency the Governor of New Zealand, first published on the 3rd day of September, 1874, in the New Zealand Gazette, been proclaimed as Hundreds: And whereas by operation of law the lands within the said Hundreds are not open for sale or lease until thirty days from and after the first publication of the proclamation constituting the Hundreds: And whereas, by the 2nd section of “The Otago Waste Lands Administration Act, 1874,” it is enacted that it shall be lawful for the Superintendent, from time to time, by proclamation in the Provincial Government Gazette, to fix a date after the said period of thirty days as the date on and after which the lands comprised in such Hundred shall be open for sale or lease, and that in such case such lands should not be open for sale or lease until the date mentioned in such last-mentioned proclamation: And whereas it is not expedient that the said land comprised in the said Hundreds should be open for sale or lease until the dates hereinafter mentioned: Now, therefore, I, James Macandrew, Superintendent of the Province of Otago, by virtue of the powers invested in me by “The Otago Waste Lands Administration Act, 1874,” and of every other power and authority vested in me enabling me in this behalf, do hereby proclaim and declare that the lands comprised in the Hundreds hereinafter named shall be open for sale or lease on the dates hereinafter mentioned, that is to say:

I proclaim and declare that all the lands comprised in the Lees Stream Hundred, in the Tuapeka Hundred, in the Dart Hundred, shall be open for sale or lease on the twentieth day of October, one thousand eight hundred and seventy-four. And I also proclaim and declare that all the lands comprised in the Dunback Hundred and in the Waikouaiti Hundred shall be open for sale or lease on the twentieth day of December one thousand eight hundred and seventy-four. And I also proclaim and declare that all the lands comprised in the Kaiwera Hundred, in the Pukerau Hundred, and in the Otaira Hundred, shall be open for sale or lease on the fourth day of January one thousand eight hundred and seventy-five. And I also proclaim and declare that all the lands comprised in the Waikaia Hundred shall be open for sale on the fifteenth day of January one thousand eight hundred and seventy-five. And I also proclaim and declare that all the lands comprised in the Waipahi Hundred, in the Kuriwao Hundred, in the Heriot Hundred, in the Spottiswood Hundred, and in the Waikaia Hundred, shall be open for sale or lease on the first day of February, one thousand eight hundred and seventy-five. And I further proclaim and declare that the Hundreds hereinbefore named are described in the proclamations of His Excellency Sir James Fergusson, Baronet, Governor of New Zealand, and published in the New Zealand Gazette of date the third day of September, one thousand eight hundred and seventy-four.

PROCLAMATION.

Cancellation of Leases to Depasture Stock on certain Crown Lands in the Province of Otago.

By His Honor James Macandrew, Superintendent of the Province of Otago, in Council.

WHEREAS by the sixteenth section of the “Gold Fields Act 1866,” it is enacted that when any Gold Mine or Gold Field shall be discovered and proclaimed upon any Crown Lands which at the date of the passing of the said Act shall have been held under license or lease for depasturing purposes, it should be lawful for the Governor, at his discretion, to cancel the lease or license under which such land shall have been held in occupation, as regards the whole or any part of the lands so held under such license or lease, or with the concurrence of the licensee, or lessee, to suspend such lease or license as regards the whole or any part of such lands: And whereas Thomas Dick, Esquire, Superintendent of the Province of Otago, by virtue and in exercise of the powers delegated to and vested in him in that behalf, did, by Proclamation in the Government Gazette of the said Province, bearing date the twenty-ninth day of January, one thousand eight hundred and sixty-seven, constitute and appoint all the lands therein described, including amongst other territory, the lands hereinafter described to be a Gold Field under the provisions of the “Gold Fields Act 1866,” to be called “Otago Gold Field:” And whereas, by the “Gold Fields Act Amendment Act 1867,” it is enacted that within any Province in which by any Act or Ordinance it is provided that the Superintendent shall in the administration of the Government thereof, act by and with the advice and consent of an Executive Council, it shall be lawful for the Governor in Council,
