Licensing District Proclamation

A PROCLAMATION.

WHEREAS by "The Licensing Act, 1873," it is amongst other things, enacted that the Governor shall, as soon as conveniently may be after the passing of the said Act, by Proclamation in the Government Gazette, define such territorial divisions as he may think proper to be Licensing Districts for the purposes of the said Act, and from time to time may alter and re-define the boundaries of the same: And whereas it is also further enacted by the said Act, that in the Proclamation declaring the said several districts, the Governor shall in each case declare the number of persons of whom the Licensing Court of such district shall consist, such number not being now nor less than three:

Now therefore, I, Sir James Fergusson, Baronet, the Governor of the Colony of New Zealand, in pursuance of the provisions of the hereinafter cited Act, do hereby proclaim, constitute, and appoint that the several territorial divisions, the boundaries whereof are defined and set forth in the Schedule hereto, shall be Licensing Districts for the purposes of the said Act; also that each such district shall be known by the name by which it is designated in the said Schedule: And I do hereby further proclaim and declare that the Licensing Court of each one of the districts hereby proclaimed, constituted, and appointed, shall consist of four Commissioners, inclusive of the Resident Magistrate, who shall at any time hereinafter be appointed by me, the Governor aforesaid, to carry into effect the provisions of the said Act within such district.

Given under the hand of His Excellency the Right Honourable Sir James Fergusson, Baronet, a Member of Her Majesty’s Most Honourable Privy Council, Governor and Commander-in-Chief in and over Her Majesty’s Colony of New Zealand and its Dependencies, and Vice-Admiral of the same; and issued under the Seal of the said Colony, at Wellington, this twenty-third day of February, in the year of our Lord, one thousand eight hundred and seventy-four.

SCHEDULE.

PROVINCE OF OTAGO.

  1. Papakaio District.

Bounded on the North by the Waitaki River; towards the South-east by the sea; on the South by the Oamaru Town and the Oamaru Stream to the Big Hill, thence by the southern boundary of the Awomoko and Maerewhenua Hundreds, to the South-west corner of the Maerewhenua Hundred; and on the West by the western boundary of the Maerewhenua Hundred to the Waitaki River.

  1. Town of Oamaru District.

Bounded towards the North-west by Blocks numbered respectively II. and IV., Oamaru Survey District, 4596 links; also by Block numbering II., 3215 links; towards the North-north-east by Block numbered L, Oamaru District, 6123 links; towards the East by high water mark of the sea, 1581 links; towards the South-east by Block numbered IV., Oamaru District, 2000 links; towards the South by Block numbered IV., 6950 links; towards the South-west by the said Block numbered IV., 6544 links; and towards the West-north-west by the said Block numbered IV., 1576 links.

  1. Kakanui District.

Bounded on the East and North-east by the Oamaru Town and the Oamaru Stream; on the North by the Papakaio District; on the West by the western boundary of the Kakanui Hundred; on the south by the southern boundary of the said Hundred to where it meets the Kauroo Stream, thence by that stream and the Kakanui River to the sea; and on the South-east by the sea.

  1. Maerewhenua District.

Bounded on the East by the Papakaio and Kakanui Districts, from the Waitaki River to the south-western corner of the Kakanui Hundred; thence on the South-east by a right line drawn to the summit of the Kakanui Peak; thence on the South-west and South by the Naseby District to Mount Ida; thence on the West by the west branch of the Otamakau River, and by that river to the Waitaki; and on the North by the Waitaki.

  1. Arrowtown District.

Bounded on the East by the Maerewhenua District from the Waitaki to Mount Ida; thence on the South-west and South by the St. Bathans District to Mount St. Bathans; thence again on the South-west by the Cromwell District to the Lindis Pass, and the Longslip Creek; thence on the East by the Longslip Creek to its junction with the Ahuriri River; thence by that river and the East Head Creek to the Waitaki; and on the North by the Waitaki.

  1. Cardrona District.

Bounded on the South-east by Cromwell District; on the East by the Ahuriri District to the Waitaki River; on the North by that river to the east branch of the Matukituki River; on the West by a line due south from said boundary to Fox’s Creek, thence along the boundary of the Dunstan Gold Field to the Treble Cone, thence along said boundary to Mount Cardrona, and thence to Queensberry Hill.

  1. Queenstown District.

Bounded on the East by the Cardrona District, the Arrow District, and the Clyde District; on the South-east by an imaginary line from Lorn Peak, on the Hector Mountains, running south-west to the Mataura River, at a point midway between Howell’s Fords, on the road to Kingston; on the South-west by the boundary of the Otago Gold Fields; Excepting the Town of Queenstown District, herein next defined.

  1. Town of Queenstown District.

Bounded towards the North-west by Crown lands 3130 links, by Cemetery Reserve 2110 links, also by Crown lands 1930 links; towards the North-east by Crown lands 4920 links; towards the South-east by Crown lands 1700 links; towards the South by Lake Wakatipu, 1500 links, be the same more or less; and towards the South-west by Crown lands, 1100 links.

  1. Arrow District.

Bounded on the East by the Cromwell District; on the South by the Clyde District on the North-west by an imaginary line from Ben Nevis on the Hector Mountains to the junction of the Shotover River with the Kawarau River, thence along the Shotover to the bridge at Foster’s Ferry, thence due north to the Coronet Peak on the Harris Mountains, and thence to Mount Hyde and the boundary of the Cardrona District; and on the North-east by the Cardrona District.

  1. Cromwell District.

Bounded on the South by the Clyde District; on the West by the Carrick Range to Kawarau River, thence by the Kirtle Burn to Queensberry Hill; on the North-west by an imaginary line from said hill to the head waters of Luggate Creek, thence by said Creek to Clutha River in a north-easterly direction to Trig Hill, thence in the same direction to the Lindis Burn, thence by the Lindis Pass, thence by the Longslip Creek to the boundary of the Otago Gold Fields; on the East, by a line along the boundary of the Otago Gold Fields to Mount St. Bathans, thence along the Dunstan Range to the head waters of the Lauder Creek, and thence by the Black’s District, excepting the Town of Cromwell District herein next defined.

  1. Town of Cromwell District.

Bounded towards the North by a line commencing on the west bank of the Clutha River and proceeding in a westerly direction, with a magnetic bearing of 269 degrees 25 min., to the north-east corner of the Cemetery Reserve, 4100 links; thence along a line in the same direction, 7100 links; thence by a line at a right angle in a southerly direction, 694.9 links; thence by a line at a right angle in an easterly direction to the Kawarau River, 4000 links; thence along the Kawarau and Clutha Rivers to the starting point, as delineated on the record map of the said town deposited in the Survey Office at Dunedin.

  • For places beyond the limits of any of the Districts herein defined, applications are to be made to the nearest Resident Magistrate or Licensing Court respectively.
