for which any such licence has been issued, will be liable
to a penalty not exceeding Ten Shillings per head for
every head of cattle so depastured, as provided by
Section XV. of the "Gold Fields Act, 1866."

  1. A list of the Depasturing Licences issued, and of
    the names of the licensees, with the quantity and description of stock which each person is authorised to
    depasture, shall be posted in the Warden’s office, so that
    it can be inspected at any time by the public.

  2. Any person depasturing swine on the before-
    mentioned lands will be liable to a penalty not exceeding
    ten pounds for the first offence, and twenty pounds
    for any second or subsequent offence.

The following shall be the form of Depasturing
Licence:—

application for a Licence to Depasture Stock upon the
Gold Field Reserve within the district of __,
and has this day paid the sum of __ : The
said __ is hereby authorised to depasture
(specify number) head of (specify great or small cattle
or horses as the case may be) upon the said Reserve, for
the term of one half year from the date hereof.

And I, the said Thomas Dick, as such Superintendent
as aforesaid, in pursuance and exercise of the power and
authority in me vested in this behalf, do hereby appoint
the undermentioned officers of the Gold Field to be
Wardens of such Reserves for the respective districts
set opposite their names (that is to say):—

Edward Croker, Esquire, R.M., Tuapeka.
Henry Wigram Robinson, Esquire, R.M., Dunstan.
Lowther Broad, Esquire, R.M., Arrow.
Richmond Beetham, Esquire, R.M., Queenstown.

PROCLAMATION

Of Regulations for the Issue of Depasturing Licences
upon certain Lands within the Proclaimed "Otago
Gold Field."

By His Honor Thomas Dick, Esquire, Superintendent
of the Province of Otago.

I, THOMAS DICK, Esquire, Superintendent of the
Province of Otago, do hereby in pursuance and
exercise of the power and authority delegated to and
vested in me in this behalf, make, proclaim and declare
the Regulations aftermentioned for the issue of Depasturing Licences on Runs numbered 3, 4, 5, 6, 7, 8,
9, 12, 13, 14, 15, 16, 17, 18, and 19, in the Wakatipu
Reserve, in the said Province, that is to say:—

REGULATIONS.

  1. Mode of disposal.

Depasturing licences for any or all of the aforesaid
Runs shall be sold by Public Auction to the highest
bidder, at such times and places as His Honor the
Superintendent shall hereafter appoint, and subject to
the Regulations and conditions hereinafter set forth.

  1. Term of Licence.

The term or period for which such depasturing licences
or any of them shall be in force, shall be ten (10)
years.

  1. Annual Assessment.

In addition to the price or premium to be paid for
any such Run, the licensee shall pay annually, in ad-
vance, the assessment or sum of seven pence (7d.) for
each head of sheep or other small cattle, and three shil-
ings and sixpence (3s. 6d.) for each horse or head
of great cattle, and such payment shall be estimated in
accordance with the assessed capabilities of every such
Run, which shall be declared at or before the time of
the sale thereof, provided that for the first year of the
licence, the rent shall only be charged on one-third of
the assessed capabilities.

  1. Terms of payment of premium.

The purchaser of any depasturing licence as aforesaid,
shall pay one-fourth or 25 per cent. of the purchase
money, in cash, immediately upon his being declared
the purchaser by the auctioneer, who shall be appointed
to conduct the sale, and the balance of the purchase
money shall be paid by approved Bills, payable respec-
tively at four (4), eight (8), and twelve (12) months,
from the day of sale.

  1. Privilege to holders of Miners’ Rights.

The holder of a miner’s right or business licence
shall at all times be permitted to run one horse or
milch cow without charge upon any lands included
within any run for which a depasturing licence shall or
may be granted as aforesaid.

  1. Mining Operations.

Nothing in these Regulations contained, or in the
depasturing licences to be issued in accordance there-
with, shall be construed as authorising the licensee to
interfere with mining operations, nor with prospecting
upon the land over which any such licence shall be
granted, nor with the free diversion of water, and all
rights and privileges accorded by the Gold Fields’ Act,
and by the Gold Fields’ Rules and Regulations, to the
holders of miners’ rights and business licences, shall
have full force and effect thereupon and thereon.

  1. Mining and Agricultural Leases.

The Superintendent reserves to himself the right to
grant gold mining and mineral leases upon lands held
under such depasturing licences without compensation
to the licensee, and also to grant agricultural leases
thereupon upon payment to the licensee of a sum to be
calculated at per acre for land so granted for agricul-
tural leases, and at the rate of double the price paid
per acre as premium for the run whereupon such agri-
cultural lease or leases shall be granted.

  1. Pre-emptive Right.

The licensee shall be entitled to purchase not ex-
ceeding eighty (80) acres of non-auriferous land without
competition on any portion of the run for which
he shall hold a depasturing licence under these Regula-
tions, provided that such purchase shall be made within
two (2) years from the date of the licence, and that
such land shall be selected in not more than two (2)
pieces or parcels.

  1. Execution of Lease.

Every depasturing licence shall be dated on the
day of execution thereof, and the term shall commence
and be computed from the first day of January, one
thousand eight hundred and sixty-eight (1868).

  1. Valuation.

At the expiration of the term of any depasturing
licence so granted, valuation will be allowed and paid
to the licensee for any improvements which he may
have made upon the run held by him hereunder, but
such valuation shall not exceed three (3) years’ assess-
ment, except any such improvements shall be of a special character, and shall have been specially authorised
or sanctioned by the Superintendent.

  1. Roads.

The Superintendent reserves the right to make roads
and tracks through any and all of the aforesaid runs,
without compensation.

  1. Cancellation of Licences.

Any depasturing licence purchased and granted
under these Regulations will be liable to forfeiture and
