In the Supreme Court of New Zealand,
Otago and Southland District.
In the matter of the Petition of JOHN WILLIAM FEGER, of Caversham, near Dunedin, in the Province of Otago, Hotel-keeper, a debtor; and in the matter of the Petition of WILLIAM BRIDGMAN, of Caversham, near Dunedin, in the Province of Otago aforesaid, a creditor of the said John William Feger to the extent of not less than Fifty Pounds; and in the matter of the "Debtors and Creditors Act, 1862 and 1865."
WHEREAS by an order of this Honorable Court, made on the fifth day of February now last past, it was ordered that John William Feger, the above-named petitioner, should forthwith cede and deliver, convey, assign, and make over, all his real and personal estate and effects whatsoever, and wheresoever, unto James Young of Dunedin aforesaid, timber merchant, and Samuel Marks of Caversham aforesaid, brewer, two of the creditors of the said John William Feger, upon trust, for the collection and conversion into money of the said estate and effects, and the distribution of the net proceeds pro rata, and subject to existing legal priorities (if any) amongst such of the creditors of the said John William Feger as should duly prove their respective debts by affidavit filed in the office of the Registrar of the said Court at Dunedin aforesaid, within the space of three calendar months from the date of the said order, and upon and subject to such other trusts and provisions as the said Court might, at or before the final hearing of the said petition, direct or approve: And whereas the said John William Feger has not, in accordance with such order, made such cession and delivery, conveyance and assignment, as aforesaid, upon reading the said order, and upon hearing Mr. Bryan Cecil Haggitt of counsel for some of the creditors of the said John William Feger, and upon hearing Mr. Ward of counsel for the said John William Feger, it is ordered that Robert Chapman, Esquire, the Registrar of this Honorable Court at Dunedin aforesaid, do and shall, in the name and on behalf of the said John William Feger, cede and deliver, convey, assign, and make over all the said petitioner’s real and personal estate and effects, unto the said James Young and Samuel Marks, upon trust, for the collection and conversion into money of the said estate and effects, and the distribution of the net proceeds pro rata, and subject to existing legal priorities (if any) amongst such of the creditors of the said petitioner as shall duly prove their respective debts by affidavit filed in the office of the Registrar of this Court at Dunedin aforesaid, within the space of three calendar months from the date of this order, and upon and subject to such other trusts and provisions as the said Court may, at or before the final hearing of the said petition, direct or approve.
