hereafter made by the said Superintendent or his successors for securing the orderly conduct of the business of the said Hotel and Ferry to the satisfaction of the Government as respects charges and otherwise: Provided always that if any Laws or Rules be passed altering the fares of the said Ferry or in the event of a Bridge being put across the River before the expiry of this demise it shall be at the option of the said Edwin Hooper to relinquish this Lease at any time within one month from the passing of such Laws or Rules: And also at the expiration of the said term shall and will if required leave and deliver up to the Superintendent of the said Province for the time being the whole of the demised premises and hereditaments in a good and sufficient state of repair receiving valuation for improvements made during this demise in manner hereinafter mentioned And also that he the said Superintendent or his said successors shall within one calendar month after this demise allow and pay unto the said Edwin Hooper his executors or administrators a sum equal to the then value of any Buildings or improvements erected or made by the said Edwin Hooper his executors or administrators and then being upon the said demised premises with the previous written approval and sanction of the Superintendent for the time being: AND it is hereby agreed by the parties to these presents that the amount so payable shall be determined in case of doubt by the written award of two arbitrators one appointed by each party in difference or if such arbitrators fail to agree in an award within Twenty-one days after their appointment then by the written award of an umpire chosen by them before entering upon the reference and either party who after receiving written notice from the other party of the appointment of an arbitrator by the party so giving notice shall fail within Ten days to appoint his or their own arbitrator shall be deemed to have made default in appointing an arbitrator and the arbitrator of the party so giving notice may proceed alone and his award shall be conclusive and the costs of and attending such Reference and award shall be equally defrayed by the two parties in difference and this present agreement for arbitration may be made a Rule of any competent Court: PROVIDED always that if the Rent hereinbefore reserved or any part thereof shall be in arrear for Twenty-one days after any of the said days whereon the same ought to be paid as aforesaid although no formal demand shall have been made or upon breach non-observance or non-performance of any of the covenants by and on the part of the said Edwin Hooper his executors or administrators it shall be lawful for the said John Larkins Cheese Richardson as Superintendent and his successors as aforesaid to re-enter upon the demised premises and re-possess and hold the same as if this demise had not been made.
