LEASE OF HOTEL & FERRY, WEST TAIERI, TO EDWIN HOOPER.
THIS DEED made the fifteenth day of September one thousand eight hundred and sixty-two BETWEEN John Larkins Cheese Richardson Superintendent of the Province of Otago of the one part and Edwin Hooper of the same Province Hotelkeeper of the other part WITNESSETH that in consideration of the Rent hereinafter reserved and of the covenants on the part of the Lessee herein contained or implied the said John Larkins Cheese Richardson as Superintendent aforesaid doth hereby demise unto the said Edwin Hooper all that piece of Land containing two roods or thereabouts be the same more or less called an Hotel Reserve being part of Crown Lands contiguous to the Upper Taieri Ferry Reserve situate in the West Taieri District in the said Province bounded towards the north-west by Crown lands five hundred links towards the north-east by a Road line one hundred links towards the south-east by River Section numbered thirty-eight same District five hundred links and towards the south by Crown lands aforesaid one hundred links together with the Hotel or Inn thereon and all the appurtenances to the Premises belonging And also all that piece of Land containing nine acres three roods and thirty-nine poles or thereabouts be the same more or less situate and being in the Township of Outram in the said Province bounded towards the west by Beaumaris-street one thousand two hundred and forty-eight links towards the north-east by Bell street eight hundred and one links towards the south-east by River Section numbered thirty-five West Taieri District aforesaid and towards the south-west by Formby-street eight hundred and one links with all the appurtenances to the same belonging as the same pieces of land are respectively delineated on the plans drawn in the margin of these presents and colored red And also all that the Upper Taieri Ferry in connection with the said Reserve and the right to ply the same and the boats and all other gear and appurtenances belonging to the said Ferry To hold the premises hereby demised unto the said Edwin Hooper his executors and administrators excluding assigns from the day of the date of these presents for the term of one year yielding and paying therefor unto the said John Larkins Cheese Richardson as Superintendent aforesaid or his successors in office as and for the rent of the said Hotel the sum of two hundred and seventy-five pounds and as and for the rent of the said Ferry the sum of one hundred and eighty-one pounds five shillings making together the rent of four hundred and fifty-six pounds five shillings without any deduction and to be paid by equal quarterly payments on the fifteenth day of December the fifteenth day of March the fifteenth day of June and the fifteenth day of September all now next ensuing And the said Edwin Hooper doth hereby for himself his heirs executors and administrators covenant with the said John Larkins Cheese Richardson as Superintendent aforesaid and his successors aforesaid that he the said Edwin Hooper his executors and administrators during the said term will pay all existing and future taxes rates charges and all other outgoings whatsoever payable whether by the Landlord or Tenant in respect of the demised premises including the expense of erecting and maintaining party fences And also will not assign this Lease or underlet or part with the possession of the said demised premises or any part thereof to any person or persons whomsoever and also will conduct the whole business of the said Ferry personally with such assistance as may be necessary for the efficient working of the same And also will ply the said Ferry at all hours unless when from the state of the weather or other cause the passage would be dangerous or impracticable And also will levy the following rates of Ferryage for the conveyance of persons carriages horses cattle sheep and goods and none other (except as hereinafter provided) that is to say for each horse mule or ass not drawing any carriage one shilling for each head of great cattle sixpence for each sheep goat and hog when under twenty two-pence for each sheep goat and hog when twenty and upwards one penny for each cart dray waggon and carriage of what kind soever exclusive of goods and passengers one shilling for each horse mule ass and bullock drawing any cart dray waggon or other carriage sixpence for each bale of wool sixpence other goods at the rate of two-pence per one hundred pounds weight and from one hour after sunset till sunrise the said rates of Ferryage respectively and one-half more shall be charged by the said Edwin Hooper his executors or administrators Provided always that the Mail and persons exhibiting a certificate under the hand of the Superintendent for the time being that such persons are on duty under the employment of Government shall be exempted from the payment of rates of Ferryage And also shall and will keep a regular and daily account of all rates of Ferryage received by or due to him or them and transmit a copy thereof to the Superintendent for the time being at the end of every month certified by the said Edwin Hooper his executors or administrators to be a true account of the rates of Ferryage levied or that were leviable by him during each and every day of the month included in such account And also will observe any laws or Rules already passed or which shall be
