Provided always, that it shall be a condition
of any one of the said districts claiming any
part of the foresaid sum of L91, that such dis-
trict, within one month from the passing of
this Ordinance, shall have raised and pro-
ceeded to expend, contributions for the fur-
therance of the objects before-mentioned within
such district, and shall satisfy the Superinten-
dent thereof: And that any part of the fore-
said sum of L91, to be issued and paid to each
of said districts, shall be in the proportion of
the amount of the contributions of each dis-
trict to the aggregate amount of the contribu-
tions of the whole of said districts, and shall not
exceed the amount of the contributions of
such district: And provided always that
no part of the sums hereby applied for
the repair of roads shall be paid by the Super-
intendent until full evidence is submitted to
him that the sums stated as having been sub-
scribed are properly expended.

  1. Out of the said Revenue there shall and
    may be issued and applied for the purposes,
    and in manner hereinafter mentioned, any sum
    or sums of money not exceeding the several
    sums hereinafter specified, nor in whole the
    sum of six hundred and twenty pounds seven-
    teen shillings and sixpence sterling; that is to
    say—

For the erection of a Council Hall,
Treasury, and Solicitor's Of-

  1. The Provincial Treasurer shall issue and
    pay from time to time any sum or sums of
    money, for the purposes hereinbefore men-
    tioned, not exceeding in whole the sums re-
    spectively specified, to such persons and in
    such portions as the Superintendent shall, by
    any order or warrant in writing signed by him
    from time to time direct; and such Trea-
    surer shall in his account be allowed credit for
    all such sums as paid by him in pursuance of such
    orders or warrants; and the receipts of the
    persons to whom such sums shall have been
    so paid shall be to him a full discharge for the
    sum or sums for which such receipts shall have
    been given; and the amount thereof shall be
    passed to his credit in account accordingly.

  2. This Ordinance shall come into operation
    from the day of the passing thereof.

FERRIES ORDINANCE.
In the Seventeenth year of the Reign of Her
Majesty Queen Victoria.
Session I. No. 8.

ANALYSIS.

Preamble.
2. Ferries to be erected.
2. Land to be appropriated for Ferry Stations.
3. Money may be borrowed to defray expense.
4. No expense to be incurred, without previous sanc-
tion of Provincial Council.
5. Ferries to be let.
6. Rates for use of ferry to be fixed by Superintendent.
7. Rules for regulating Ferries to be made.

An Ordinance to Establish and Regulate Ferries.
WHEREAS the establishment of Ferries
on Rivers, Creeks, and Lakes, within
the Province of Otago, would now, or here-
after promote the convenience of the Public,
and greatly facilitate communication between
various parts of the Province, and between
said Province and the neighboring Province of
Canterbury.

Be it enacted by the Superintendent of the
Province of Otago, with the advice and con-
sent of the Provincial Council thereof, as
follows:—

  1. It shall be lawful for the Superintendent
    to authorise Ferries to be established and
    erected at convenient places on the Rivers,
    Creeks, and Lakes within the Province of
    Otago, for the conveyance of passengers,
    animals, and goods across the same.

  2. For such purpose it shall be lawful for
    the Superintendent to reserve and appropriate
    on or near to every river, creek, or
    lake, a water frontage of such extent as
    shall be considered suitable for the convenient
    erection of a ferry, and also adjoining to the
    ferry on either side of such river, creek, or
    lake, a piece of land not exceeding fifty acres
    for the use of the ferryman, or person in
    charge of the ferry, and his family, and for
    erecting and maintaining thereon a house
    or inn, with stockyards, stables, and other accommo-
    dations for the convenience of the public.

  3. It shall be lawful for the Superintendent
    when funds are required for the erection or
    maintenance of any ferry, to procure and lay
    before the Provincial Council detailed esti-
    mates of the expense; and upon such estimates
    being approved by the Provincial Council, it
    shall further be lawful for him to borrow any
    sum of money not exceeding the amount of
    said estimates, to be applied for the purposes
    specified therein.
