Notification of Commerce Commission’s Final TSO Cost Calculation Determination in Relation to the TSO Instrument for the Telecommunications Relay Services for the Period Between 1 July 2011 and 30 June 2012
On 28 June 2013, the Commerce Commission, pursuant to section 94J of the Telecommunications Act 2001 (“the Act”), prepared a Final TSO Cost Calculation Determination of the matters set out in section 94K of the Act in relation to the TSO instrument for telecommunications relay services for the hearing impaired, for the period between 1 July 2011 and 30 June 2012.
Pursuant to sections 94J(1)(b) and 6 of the Act, the Commission has given public notice of its Final TSO Cost Calculation Determination.

Electricity Industry (Exemption No. 168 (Arc Innovations Limited)) Exemption Notice 2013
Pursuant to section 11 of the Electricity Industry Act 2010 (“Act”), the Electricity Authority gives the following notice.
Notice
- Title and commencement—(1) This notice is the Electricity Industry (Exemption No. 168 (Arc Innovations Limited)) Exemption Notice 2013.
(2) This notice comes into force on 29 August 2013.

Exemption—Arc Innovations Limited (“Arc”) is exempted from compliance with item 16 of Table 1 of Schedule 11.4 of the Electricity Industry Participation Code 2010 (“Code”) in respect of providing metering component serial numbers for its first generation advanced metering infrastructure (AMI) metering installations.

Term—This exemption expires at the close of 31 December 2018.

Reasons for granting the exemption—The reasons for granting this exemption are:
(a) granting the exemption meets the requirements in section 11(2) of the Act for granting exemptions;
(b) traders supplying installation control points (“ICPs”) that use Arc’s first generation AMI metering installations would incur higher administration and compliance costs in changing their internal systems to align existing customer metering records with the new serial numbers in the registry; and
(c) the exemption will have little or no impact on service providers or other traders supplying ICPs that do not use Arc’s first generation AMI metering installations, and will not affect any other Code provisions.

Pursuant to section 11 of the Electricity Industry Act 2010 (“Act”), the Electricity Authority gives the following notice.

- Title and commencement—(1) This notice is the Electricity Industry (Exemption No. 169 (Mighty River Power Limited)) Exemption Notice 2013.
(2) This notice comes into force on the day after the date it is notified in the New Zealand Gazette.
- Exemption—Mighty River Power Limited (“MRPL”) is exempted from complying with the obligation in clause 8(g) of Schedule 15.3 of the Electricity Industry Participation Code 2010 (“Code”) to provide non half hour (“NHH”) submission information for the following 16 installation control points (“ICPs”):

Reasons for granting the exemption—The reasons for granting this exemption are:
(a) granting the requested exemption meets the requirements in section 11(2) of the Act for granting exemptions;
(b) MRPL would incur significant administration and compliance costs changing its systems to provide submission information for the 16 ICPs in NHH format instead of in the half hour (“HHR”) format it currently provides;
(c) MRPL’s systems replicate the profiling process used in the reconciliation manager’s system by converting NHH quantities into an HHR “shape” using on and off switch times recorded by a certified data logger and provide a similar level of accuracy;
(d) the load at these ICPs is static, has little annual variation, and load changes can be accurately tracked; and
(e) the requested exemption will have little or no impact on other participants and service providers, and will not affect any other Code provisions.
