Notice of Intention to Consider Varying a Scheduled International Air Service Licence

Pursuant to section 87J(3) of the Civil Aviation Act 1990, sections 41 and 42 of the State Sector Act 1988, and a delegation from the Secretary for Transport dated 6 November 2007, I give notice that having received an application from Air New Zealand Limited, the Minister of Transport intends to consider varying the scheduled international air service licence held by that airline in order to provide for the airline to market code-share services to Turkey, with capacity as filed with and acknowledged by the Secretary for Transport.

Any person wishing to make representations to the Minister of Transport relating to this application must forward those representations in writing to reach me at the Ministry of Transport, PO Box 3175, Wellington 6140, on or before 3 May 2013.

Electricity Industry Act 2010

Electricity Industry (Exemption No. 163 (Electricity Ashburton Limited)) Exemption Notice 2013

Pursuant to section 11 of the Electricity Industry Act 2010 (“Act”), the Electricity Authority gives the following notice.

Notice

  1. Title and commencement—(1) This notice is the Electricity Industry (Exemption No. 163 (Electricity Ashburton Limited)) Exemption Notice 2013.

(2) This notice comes into force on 31 May 2013.

  1. Exemption—Electricity Ashburton Limited (“EASH”) is exempted from compliance with the following clauses of the Electricity Industry Participation Code 2010 (“Code”) in respect of the EASH embedded network connected to the network supply point URK0111:

(a) clause 10.3(f)(i); and

(b) clause 15.38.

  1. Term—This exemption expires on the close of 31 May 2023.

  2. Reasons for granting the exemption—The reasons for granting this exemption are:

(a) the proposed exemption meets the requirements in section 11(2) of the Act for granting exemptions;

(b) without an exemption to clause 10.3(f)(i), EASH would incur significant expenditure and complexity in fitting metering and communication equipment at both points of connection between the local network owned by Orion New Zealand Limited and the EASH embedded network, with relatively low consumption volumes;

(c) without the exemption to clause 15.38, EASH would incur significant expenditure in gaining full certification to allow it to continue modelling and submitting information to the reconciliation manager for settlement of relatively low consumption volumes for the 10 installation control points (“ICPs”) on the EASH embedded network at URK0111;

(d) the historical nature of the connections and impracticability of connecting strictly in accordance with the Code;

(e) due to the small number of ICPs involved, there would be little or no impact on other participants and service providers, and it would not affect any other Code provisions; and

(f) EASH has in place a materially accurate method to calculate consumption for settlement.
