Notice

1. Title and commencement

(1) This notice is the Electricity Industry (Exemption No. 167 (The Power Company Limited)) Exemption Notice 2013.

(2) This notice comes into force on the day after the date it is notified in the New Zealand Gazette.

2. Exemption

The Power Company Limited (“TPCO”) is exempted from compliance with clause 10.3(f)(ii) of the Electricity Industry Participation Code 2010 (“Code”) in respect of the existing interconnection point between the TPCO network and the Electricity Invercargill Limited (“ELIN”) local network.

3. Term

This exemption expires at the close of 31 March 2023.

4. Reasons for granting the exemption

The reasons for granting this exemption are:

(a) granting the exemption meets the requirements in section 11(2) of the Act for granting exemptions;

(b) the interconnection point provides an emergency back-up supply to Southland Hospital from the ELIN network and is likely to be only rarely used;

(c) without an exemption to clause 10.3(f)(ii), TPCO would incur significant expenditure in fitting metering and communication equipment to the interconnection point for which there would be little benefit;

(d) TPCO has in place a materially accurate method to calculate consumption for settlement at the interconnection point in the unlikely event it is utilised; and

(e) the exemption could have a minor financial impact on traders on the ELIN network, but will have no impact on service providers, and will not affect any other Code provisions.

Hazardous Substances and New Organisms Act 1996

Notice of Intention to Apply for Approval of Code of Practice

Pursuant to section 79 of the Hazardous Substances and New Organisms Act 1996 (“HSNO Act”), the Environmental Protection Authority gives notice it intends to apply for approval of the code of practice HSNOCOP 63 Management and handling of used oil.

This code specifies the requirements for the storage and handling of used oil.

The code sets a means of compliance with:

  • the Lubricants (Toxic) Group Standard 2006;
  • the Lubricants (Combustible Toxic) Group Standard 2006; and
  • the controls on the approvals under part 5 of the HSNO Act for fuel oil manufactured from waste lubricating oil – HSNO approval number HSR001522 and non-flammable fuel oil manufactured from waste lubricating oil – HSNO approval number HSR100772.
