Notice of Application Received by the Commerce Commission for Addition to the Register of Chorus’ Non-retail Users

Under section 69P(4) of the Telecommunications Act 2001, the Commerce Commission (“Commission”) gives public notice of an application by Infrastructure Logic Pty Limited to be added to the Register of Chorus’ non-retail users.

Electricity Industry Act 2010

Electricity Industry (Exemption No. 160 (Contact Energy Limited)) Exemption Notice Revocation Notice 2013

Pursuant to section 11(3) of the Electricity Industry Act 2010 (“Act”), the Electricity Authority (“Authority”) gives the following notice.

Notice

1. Title and commencement—(1) This notice is the Electricity Industry (Exemption No. 160 (Contact Energy Limited)) Exemption Notice Revocation Notice 2013.

(2) This notice comes into force on the day after the date it is notified in the New Zealand Gazette.

2. Revocation—The Electricity Industry (Exemption No. 160 (Contact Energy Limited)) Exemption Notice 2012* is revoked.

3. Reasons for revoking the exemption—The reasons for revoking this exemption are:

(a) revoking the exemption meets the requirements in section 11(3) of the Act for revoking exemptions;

(b) in November 2012, the Authority approved the Electricity Industry (Exemption No. 160 (Contact Energy Limited)) Exemption Notice 2012 (“Exemption 160”) being granted, to exempt Contact Energy Limited (“Contact”) from clause 11 of Schedule 15.3 of the Electricity Industry Participation Code 2010 (“Code”);

(c) the Gazette Notice for Exemption 160* incorrectly exempts Contact only from subclause (3) of clause 11 of Schedule 15.3 of the Code; and

(d) the Authority has subsequently issued a corrected Gazette Notice†, which exempts Contact from all of clause 11 of Schedule 15.3 of the Code, making Exemption 160 redundant.

Electricity Industry (Exemption No. 186 (Flick Energy Limited)) Exemption Notice 2013

Pursuant to section 11 of the Electricity Industry Act 2010 (“Act”), the Electricity Authority gives the following notice.

Notice

1. Title and commencement—(1) This notice is the Electricity Industry (Exemption No. 186 (Flick Energy Limited)) Exemption Notice 2013.

(2) This notice comes into force on the day after the date it is notified in the New Zealand Gazette.

2. Exemption—Flick Energy Limited (“Flick”) is exempted from complying with the obligation in clause 15.38 of the Electricity Industry Participation Code 2010 (“Code”) to obtain and maintain certification.

3. Term—This exemption expires at the earlier of:

(a) the close of 30 June 2014; and

(b) Flick being responsible for more than 100 installation control points (“ICPs”).

4. Reasons for granting the exemption—The reasons for granting this exemption are:

(a) granting the exemption meets the requirements in section 11(2) of the Act for granting exemptions;

(b) the exemption is only needed on a short term basis;

(c) granting the exemption will assist a small new entrant retailer to enter the market, which could lead to increased competition for the long-term benefit of consumers;

(d) Flick will not have sufficient data to make an audit required for certification meaningful as some processes and procedures will not have been used in production; and

(e) due to the small number of ICPs involved, the exemption will have little or no impact on other participants and service providers, and will not affect any other Code provisions.
