Fisheries (Amateur Fishing) Regulations 1986

Fisheries (Amateur-Fishing Charter Vessel Reporting) Notice 2012 (Notice MPI No. 81)

Pursuant to Regulation 26B of the Fisheries (Amateur Fishing) Regulations 1986 and section 190 of the Fisheries Act 1996, the Chief Executive of the Ministry for Primary Industries gives the following notice.

Notice

1. Title—This notice is the Fisheries (Amateur-Fishing Charter Vessel Reporting) Notice 2012.

2. Commencement—This notice comes into effect upon notification in the New Zealand Gazette.

3. Interpretation—In this notice:

“fishing event” means the initial fishing location, fishing method, or target species of the fishing trip and every change to any of the location, fishing method, or target species during the fishing trip.

“fishing trip” means any trip where people actively fishing are on board a vessel operated by an amateur-fishing charter vessel operator.

“catch report” means in relation to certain fisheries management areas a report of both the number of fish of a stock caught and the number of fish of a stock retained for each fishing event, and where required the weight of fish of a stock caught.

“activity report” means a report for each fishing event within a fishing trip.

4. Amateur-fishing charter vessel operator must provide information—(1) An amateur-fishing charter vessel operator must provide information to the Chief Executive.

(2) Any person required to provide information must provide for each vessel operated and each fishing trip:

(a) the MNZ/MSA number of the vessel;

(b) the name of the vessel;

(c) port of departure;

(d) the date of the fishing trip;

(e) the number of people actively fishing;

(f) the MPI client number;

(g) the activity reports; and

(h) the catch reports:

(i) in relation to FMAs 2,3,4,5,6,7,8 the following species:

(A) Blue cod (Parapercis colias)

(ii) in relation to all of New Zealand Fisheries waters, the following species:

(A) Hapuku (Polyprion oxygeneious)

(B) Bluenose (Hyperoglyphe antartica)

(C) Bass (Polyprion americanus)

(D) Kingfish (Seriola lalandi)

(E) Southern bluefin tuna (Thunnus maccoyii)

(F) Pacific bluefin tuna (Thunnus orientalis)

(G) Spiny red rock lobster (Jasus edwardsii)

(iii) in relation to Pacific bluefin tuna and Southern bluefin tuna, either the weight or the estimated weight of the fish.

5. Method of providing information—(1) An amateur-fishing charter vessel operator must provide information either:

(a) on a form provided by the chief executive for the purpose of providing information; or

(b) by electronic means, if authorised by the chief executive, in such a manner as to reliably and comprehensively provide the information required.

(2) For the purpose of providing a catch report:

(a) all weights required must be recorded or estimated in kilograms;

(b) all times in relation to a fishing event must be recorded in hours and minutes;

(c) any area in relation to a fishing event must be recorded as the latitude and longitude to the nearest minute of each location where each fishing event occurred; and

(d) all dates in relation to a fishing trip must be recorded in the form dd/mm/yy.

(3) A person who is required to provide information must:

(a) provide all information required:

(i) in duplicate; and

(ii) in a legible and durable manner; and

(b) retain a copy of the information on the vessel at all times when the vessel is being used as an amateur-fishing charter vessel.

6. When to provide information—A person who is required to provide information must, for each fishing trip, provide the information to the chief executive not later than 15 days after the last day of each calendar month in which the fishing trip took place.
