Electricity Industry (Exemption No. 145 (TrustPower Limited)) Exemption Notice 2012

Pursuant to section 11 of the Electricity Industry Act 2010 (“Act”), the Electricity Authority gives the following notice.

Notice

  1. Title and commencement—(1) This notice is the Electricity Industry (Exemption No. 145 (TrustPower Limited)) Exemption Notice 2012.

(2) This notice comes into force on the day after the date it is notified in the New Zealand Gazette.

  1. Exemption—(1) TrustPower Limited (“TrustPower”) is exempted from compliance with clause 10.3(b) of the Electricity Industry Participation Code 2010 (“Code”) and clause 11 of Schedule 15.3 of the Code.

(2) This exemption only applies to installation control point 0000049939NT7FB.

  1. Term—This exemption expires on the date on which the Electricity Industry Participation (Metering Arrangements) Code Amendment 2011 comes into force.

  2. Reasons for granting the exemption—The reasons for granting this exemption are:

(a) Granting the exemption meets the requirements in section 11(2) of the Act for granting exemptions;

(b) TrustPower would incur significant expenditure and complexity in fitting a meter to the street lights for low consumption volumes;

(c) TrustPower would incur significant ongoing compliance costs if it was required to provide a distributed unmetered load database for low consumption;

(d) the load is static and will have little annual variation. Most load changes can be accurately tracked;

(e) the exemption will have little or no impact on other participants and service providers, and will not affect any other Code provisions; and

(f) TrustPower has stated it will treat the load as standard unmetered load and record the information in the Registry.

Electricity Industry (Exemption No. 146 (TrustPower Limited)) Exemption Notice 2012

Pursuant to section 11 of the Electricity Industry Act 2010 (“Act”), the Electricity Authority gives the following notice.

Notice

  1. Title and commencement—(1) This notice is the Electricity Industry (Exemption No. 146 (TrustPower Limited)) Exemption Notice 2012.

(2) This notice comes into force on the day after the date it is notified in the New Zealand Gazette.

  1. Exemption—(1) TrustPower Limited (“TrustPower”) is exempted from compliance with clause 10.3(b) of the Electricity Industry Participation Code 2010 (“Code”).

(2) This exemption only applies to installation control points (“ICPs”) 0007146030RN41C, 0007146031RN859, 0007146032RN499, 0007146034RN516, 0007146035RN953 and 0007146036RN593.

  1. Term—This exemption expires on the earlier of:

(a) the date on which the six ICPs are all metered; and

(b) the date on which TrustPower no longer has the responsibility for the ICPs once they switch to another trader.

  1. Reasons for granting the exemption—The reasons for granting this exemption are:

(a) Granting the exemption meets the requirements in section 11(2) of the Act for granting exemptions;

(b) the load is static and will have little annual variation. Most load changes can be accurately tracked;

(c) the exemption will have little or no impact on other participants and service providers, and will not affect any other Code provisions; and

(d) TrustPower has stated it will install meters at the ICPs once contracting resources are available.

Electricity Industry (Exemption No. 150 (Payless Energy Limited)) Exemption Notice 2012

Pursuant to section 11 of the Electricity Industry Act 2010 (“Act”), the Electricity Authority gives the following notice.

Notice

  1. Title and commencement—(1) This notice is the Electricity Industry (Exemption No. 150 (Payless Energy Limited)) Exemption Notice 2012.

(2) This notice comes into force on 1 October 2012.

  1. Exemption—Payless Energy Limited (“Payless”) is exempted from compliance with the obligation in clause 15.38 of the Electricity Industry Participation Code 2010 (“Code”) to obtain and maintain certification.

  2. Term—This exemption expires at the earlier of:

(a) the close of 31 March 2013; and

(b) Payless being responsible for more than 10 installation control points (“ICPs”).

  1. Reasons for granting the exemption—The reasons for granting this exemption are:

(a) Granting the exemption meets the requirements in section 11(2) of the Act for granting exemptions;

(b) the exemption is only needed on a short-term basis;

(c) granting the exemption will assist a small new entrant to enter the market, which could lead to increased competition for the long-term benefit of consumers;

(d) due to the small number of ICPs involved, the exemption will have little or no impact on other participants and service providers, and will not affect any other Code provisions; and

(e) Payless will not have sufficient data to make an audit required for certification meaningful as some processes and procedures will not have been used in production.
