Notice of Approval of Code of Practice
Pursuant to section 79(5) of the Hazardous Substances and New Organisms Act 1996, the Environmental Risk Management Authority New Zealand (“ERMA New Zealand”) advises that it approved in May 2011, the code of practice HSNOCOP 38 Version 1.0 In-situ Filling of LPG Cylinders.
Regulation 62(4)(c) of the Hazardous Substances (Compressed Gases) Regulations 2004 enables ERMA New Zealand to approve a code of practice whereby cylinders can be filled without requiring the cylinder to be weighed.
This code is intended to provide a means by which filling of cylinders by volume can be undertaken in-situ from a road tank wagon utilising an ullage or contents gauge.
This code can be inspected at the Wellington office of ERMA New Zealand, Level 1, BP House, 20 Customhouse Quay, Wellington, or can be downloaded from the website of the LPG Association of New Zealand Inc

Notice of Exemption From Maritime Rules: 21.9(1)(b); 21.13(1)(b); 31A.7(1)(c); 31A.13, Table 4; 31C.7(1)(b); 40A.10(1)(a) and (b); 40A.33(2)(e); 40A.56(1); 40C.52(1), Appendix 3.2(2)(a); 40E, Appendix 1, Clause 2(2); 45.25(2)(a) and (b)
Pursuant to section 47(3) of the Maritime Transport Act 1994, the Director of Maritime New Zealand hereby notifies the granting of the following exemptions:

1 from Maritime Rule 21.9(1)(b) – Safe Ship Management Systems – Ships which do not proceed beyond restricted limits, fishing ships, and ships less than 45 metres in length which are not required to comply with section 1 – application of section 2 – commercial ship or other than a fishing ship which does not proceed beyond restricted limits
