Purpose

• To identify registered persons of motor vehicles within the forestry estates NZ Private Fire Services Limited provides security for, where the vehicles are unattended or have not been able to be stopped or, where vehicles are stopped, to confirm that details supplied are accurate.
• To identify registered persons of motor vehicles in order to issue trespass notices.

Term

From the date NZ Private Fire Services Limited receives the final decision on its application to 31 May 2015.

Conditions

(a) The names and addresses are accessed only by NZ Private Fire Services Limited on its own behalf and solely for its own use;

(b) The names and addresses are accessed only for the specified purpose;

(c) The fees charged for the provision of the names and addresses from the Motor Vehicle Register are duly paid;

(d) Any identified instances of unauthorised access are immediately notified to the Secretary for Transport and the Privacy Commissioner;

(e) Before being permitted to access the Motor Vehicle Register under section 241 of the Act, all staff must receive training that emphasises that such access must only be for the specified purpose, and refresher training of all staff also must be undertaken at appropriate intervals;

(f) Access must be restricted solely to members of staff for whom authorised access is essential to achieving a specified purpose;

(g) The names and addresses obtained under this authorisation shall not be disclosed to any third party unless such disclosure is necessarily incidental to achieving a specified purpose; and

(h) The terms and conditions, if any, imposed by the NZ Transport Agency for access to Motor Vehicle Register information.

Electricity Industry Act 2010

Electricity Industry (Exemption No. 131 (TrustPower Limited)) Exemption Notice 2011

Pursuant to section 11 of the Electricity Industry Act 2010, the Electricity Authority (“Authority”) gives the following notice.

Notice

1. Title and commencement—(1) This notice is the Electricity Industry (Exemption No. 131 (TrustPower Limited)) Exemption Notice 2011.

(2) This notice comes into force on the day after the date it is notified in the New Zealand Gazette.

2. Exemption—TrustPower Limited (“TrustPower”) is exempted from compliance with clause 13(2) of Schedule 15.5 of the Electricity Industry Participation Code 2010 (“Code”).

3. Term—This exemption expires at the close of 31 May 2013.

4. Reasons for granting the exemption—The reasons for granting this exemption are:

(a) No other participant has alleged a breach (the industry is currently working around the issue);

(b) TrustPower’s new internal system will ensure compliance with the Code and it will not be pragmatic for TrustPower to update its current system; and

(c) TrustPower’s key information is being submitted to the Reconciliation Manager in accordance with the Code.
