Electricity Governance Regulations 2003

Electricity Governance Regulations (Exemption No. 120 (Transpower New Zealand Limited)) Exemption Notice 2010

Pursuant to Regulation 194 of the Electricity Governance Regulations 2003, the Electricity Commission gives the following notice.

Notice

  1. Title and commencement—(1) This notice is the Electricity Governance Regulations (Exemption No. 120 (Transpower New Zealand Limited)) Exemption Notice 2010.

(2) This notice comes into force on 30 September 2010.

  1. Exemption—Transpower New Zealand Limited, in its capacity as the system operator (“system operator”), is exempted from compliance with the requirement in Rule 6.1.2 of Part J of the Electricity Governance Rules 2003 for the system operator to notify the reconciliation manager of the trading periods during which points of connection to the grid were supplied from an alternative point of connection.

  2. Terms and conditions—This exemption is granted on the condition that it expires at the earlier of:

(a) 29 September 2012; or

(b) when a rule change is completed to remove this obligation from the system operator.

  1. Reasons for granting the exemption—The reasons for granting this exemption are:

(a) the system operator does not have the information that the rule requires for notification;

(b) the rule is inappropriately worded and an amendment will be proposed at the next opportunity, to ensure the correct party will deliver the required information;

(c) the granting of this exemption will not affect any other participants or service providers and does not impact on any other rules.

Hazardous Substances and New Organisms Act 1996

Notice of Approval of Code of Practice

Pursuant to section 79(5) of the Hazardous Substances and New Organisms Act 1996 (“HSNO Act”), the Environmental Risk Management Authority advises that it approved on 16 September 2010, the Code of Practice “Preparing for a chemical emergency”.

This code has been developed by Responsible Care New Zealand Incorporated (formerly New Zealand Chemical Industry Council) and provides a means of compliance with the emergency management requirements of:

  • Hazardous Substances (Emergency Management) Regulations 2001;
  • Hazardous Substances (Compressed Gases) Regulations 2004;
  • Site and storage conditions for aerosols;
  • Site and storage conditions for compressed gases;
  • Site and storage conditions for class 3.1 flammable substances;
  • Site and storage conditions for class 4 substances;
  • Site and storage conditions for class 5.1.1 oxidising substances and 5.2 organic peroxides;
  • Site and storage conditions for toxic, corrosive and ecotoxic substances; and
  • Hazardous Substances (Dangerous Goods and Scheduled Toxic Substances) Transfer Notice (as amended) 2004.

Pursuant to section 80(1) of the HSNO Act, this code may be inspected on request at the Wellington office of the Environmental Risk Management Authority of New Zealand, Level 1, BP House, 20 Customhouse Quay, Wellington.

Notice of Intention to Apply for Approval of Code of Practice

Pursuant to section 79 of the Hazardous Substances and New Organisms Act 1996, the Environmental Risk Management Authority (ERMA) gives notice that the Environmental Risk Management Agency intends to apply for approval of the Code of Practice to test compressed gas cylinders according to AS 2337.1:2004 and AS 2337.3:2006.

Under Regulation 52(3)(d) of the Hazardous Substances (Compressed Gases) Regulations 2004, ERMA may approve a code of practice that specifies testing requirements equivalent to the requirements of the standard referred to in Regulation 52(3)(b), AS 2337.1:1999.

The Environmental Risk Management Agency has applied for AS 2337.1:2004 and AS 2337.3:2006 to be approved under this Regulation.
