Notice of Entry into Possession of Mortgaged Property

In the matter of section 156 of the Property Law Act 2007, and in the matter of mortgage instrument 6892738.2 (North Auckland Land Registry) (“the mortgage”):

TEA Custodians (Bluestone) Limited (“the mortgagee” under the mortgage) gives notice as follows:

1. On 28 July 2009, the mortgagee entered into possession of the mortgaged property.
2. The description of the mortgaged property is Lot 116 DP 56904 (Computer Freehold Register NA10C/1065) (North Auckland Land Registry), being the property at 4 Matai Street, Waiuku.

The notice of direction to appoint a limited statutory manager for the board of trustees of Omaio School (as published in the New Zealand Gazette, 4 September 2008, No. 136, page 3619) is hereby revoked under section 78M(7) of the Education Act 1989.

Pursuant to section 78M of the Education Act 1989, I direct the Secretary for Education to appoint a limited statutory manager for Te Kura o Otangarei Board of Trustees because of the risks to the educational achievement of the students at the school.

The following functions, powers and duties of the board are to be vested in a limited statutory manager:

• All functions, powers and duties of the board as an employer (whether statutory or otherwise); and
• all functions, powers and duties of the board to establish processes for planning and reporting (whether statutory or otherwise) including charter review, strategic planning, and annual planning.

A limited statutory manager must also advise the board on the following:

• Improving financial management processes and policies;
• communication and consultation with the community; and
• curriculum management, including teaching and assessment practice.

This notice takes effect the day after the date of publication.
