The Auckland Medical Benevolent Fund

Application for Approval of a Scheme of Variation

Take notice that the trustees of The Auckland Medical Benevolent Fund have proposed a scheme under the Charitable Trusts Act 1957 to the trust.

Particulars

The scheme provides for the approving of the resettlement of the existing funds of The Auckland Medical Benevolent Fund onto a charitable trust registered pursuant to the Charities Act 2005 and known as The Auckland Medical Benevolent Fund, and the winding up of the undocumented charitable trust known as The Auckland Medical Benevolent Fund.

The scheme is to be considered by the High Court at Wellington.

Date Proposed for Hearing

The proposed date for hearing of the application by the High Court at Wellington shall be on 8 April 2008 at 10.00am under CIV-2008-485-349, in the matter of Baird v The Attorney General.

Opposition to Scheme

Any person desiring to oppose the scheme shall give written notice of his/her intention to do so to the Registrar of the High Court at Wellington and to the trustees (whose address for service is PO Box 5020, Wellesley Street, Auckland) and the Attorney-General not less than seven (clear) days before the date of the hearing.

Trans-Tasman Mutual Recognition Act 1997

Notice of Intention to Make a Recommendation

Under Section 82(2) of the Trans-Tasman Mutual Recognition Act 1997

Pursuant to section 75 of the Trans-Tasman Mutual Recognition Act 1997 (“the Act”), I give notice of my intention to make a recommendation to the Governor-General, under section 82(2), to make Regulations extending the exemption period referred to in section 82(1) of the Act for a period of 12 months from 1 May 2008 in relation to the laws, and the provisions of the laws, specified or described in Schedule 3 of the Act.

The making of such a recommendation is subject to my being satisfied, as required by section 82(2) of the Act, that no fewer than two-thirds of the participating jurisdictions have endorsed the terms of the proposed Regulations.
