Pursuant to sections 159X and 159Y of the Education Act
1989, the Tertiary Education Commission (TEC) published
the Requirements and Exemptions for Profiles (Investment
Plans) for 2008–2010 for Tertiary Education Organisations
Notice 2007 (“the principal notice”)*, outlining the
requirements and exemptions for Profiles (Investment Plans)
for 2008–2010. -
New Clause 3 of the Principal Notice—Clause 3 of the
principal notice is hereby amended by revoking clause 3 and
replacing it with the following:
“From 2008, the term ‘Investment Plan’ will be used to
generally describe ‘Profiles’.”

However, in order to be consistent with the existing
legislation, Profile is used in the remainder of this notice. -
Parliament is currently considering the Education
(Tertiary Reforms) Amendment Bill which, amongst other
things, is intended to streamline planning and reporting
requirements for Tertiary Education Organisations (TEOs). -
To avoid any confusion, however, the TEC confirms
that:
(a) the development and approval of Profiles for
2008–2010, as envisaged by the principal notice,
will take place within the existing Profile provisions
of the Education Act 1989 (namely, sections 159X
and 159Y);
(b) Profiles will be the output of dialogue between each
organisation and the TEC;
(c) the legislative framework relating to charters
(particularly sections 159M and 159N of the
Education Act 1989) continues to apply, unaffected
by anything that is contained in either the principal
notice or this notice; and
(d) the content and decision-making criteria set out
in the principal notice satisfy the requirements of
section 159X of the Education Act 1989 and are
not affected by this notice.\n
8. Public Administration Requirements for TEIs
(Universities, Institutes of Technology and Polytechnics,
and Wānanga)—Pursuant to section 159X(1)(c) of
the Education Act 1989, the TEC requires Tertiary
Education Institutions (TEIs) to include a range of public
administration information in their Profiles. An Investment
Guidance Supplement explaining the public administration
requirements to be addressed in Profiles for TEIs will be
available on the TEC’s website at
www.tec.govt.nz
from 2 August 2007. Alternatively, a copy of the
supplement can be obtained from:

Pursuant to section 70A of the Education Act 1989,
and pursuant to an authority delegated to me, I, Paul
Dickson Burke, Group Manager Property, Ministry of
Education, Wellington, hereby give the following notice.
