Dumping and Countervailing Duties Act 1988

Notice of Initiation: Review of Anti-dumping Duty Applying to Imports of Canned Peaches From South Africa

Pursuant to section 14(8) of the Dumping and Countervailing Duties Act 1988, and acting under delegated authority from the Chief Executive of the Ministry of Economic Development, I have initiated a review of the imposition of anti-dumping duty in respect of the goods described in the Schedule to this notice ("the goods").

This initiation follows the receipt of an application made by the New Zealand industry providing positive evidence justifying the need for a review.

Anti-dumping duty was imposed on the goods following a determination made on 1 August 1996.

The current rate of duty on the goods results from a reassessment of the duty on 11 June 2002, and published in the New Zealand Gazette, 4 July 2002, No. 76, page 2020.

Description of Goods
Canned peaches (halves, slices and pieces) packed in various concentrations of sugar syrup and in can sizes ranging from 110 grams to 3 kilograms (A10).

The goods are classified under Tariff Item and Statistical Key 2008.70.09.00L of the Tariff of New Zealand, which classification is provided for convenience and Customs purposes only, the written description being dispositive.

Telecommunications Act 2001

Appointment as Telecommunications Commissioner and as a Member of the Commerce Commission

Pursuant to section 9 of the Telecommunications Act 2001, His Excellency the Governor-General of New Zealand has appointed

Ross Henry Patterson
as Telecommunications Commissioner and as a member of the Commerce Commission, pursuant to section 28(1) of the Crown Entities Act 2004.

Both appointments are for a term of five years commencing on 12 July 2007 and expiring on 11 July 2012.

Education Act 1989

Alternative Constitution for the Board of Trustees of Kaikoura High School (307)

Pursuant to section 105A of the Education Act 1989, I hereby approve the following constitution for the board of trustees of Kaikoura High School:

  • The principal;
  • three elected parent representatives;
  • one elected staff representative;
  • one elected student representative;
  • up to two ministerial appointees, one of whom may be designated board chairperson;
  • up to three trustees appointed by Te Runanga o Kaikoura Inc; and
  • up to two trustees co-opted by the board.

The appointment or co-option of a trustee may be for a term not exceeding three years.

The parent representatives will be elected in accordance with sections 96(2) and 101 of the Education Act 1989 ("the Act") and the Education (School Trustees Election) Regulations 2000 ("Election Regulations").

The staff representative and student representative will be elected in accordance with sections 97(1) and (2) and 101 of the Act and the Election Regulations.

In addition, all relevant provisions under Part 9 of the Act will apply to the parent, staff and student representatives.

For the first elections for parent representatives, a staff and a student representative, a returning officer will be appointed by the commissioner and will carry out the duties in accordance with the Election Regulations.

For subsequent elections for parent representatives, a staff and a student representative, a returning officer will be appointed by the board and will carry out the duties in accordance with the Election Regulations.

Casual vacancies for all elected trustees will arise in accordance with section 104 of the Act, and will be filled in accordance with section 105 of the Act.

The appointment of appointed trustees is solely at the discretion of the appointing bodies.

Vacancies for appointed trustees must be notified promptly by the board to the appointing bodies and such vacancies will be filled by appointment in the same manner as the vacating trustee was appointed for the residue of the term of the vacating trustee.

Trustees elected and appointed to the first board established under section 105A of the Act will take office on 24 August 2007.

This notice takes effect the day after the date of its publication.
