Civil Aviation Rules—Notification of Proposal to Make Ordinary Rules

In accordance with section 34 (1) (a) of the Civil Aviation Act 1990, the Minister of Transport hereby gives notice of intention to make the following ordinary Civil Aviation Rule:

Part 61—Pilot Licences and Ratings – Stage 3/Part 141. NPRM No. 07-05, CAA Docket 4/CAR/5

The purpose of this NPRM is to put forward for consultation amendments to Civil Aviation Rule Part 61, Pilot Licences and Ratings, along with associated changes to Parts 1, 12, 63, 65, 66, 92, 121, 125, 135 and 141.

This NPRM is the third stage of a three stage implementation project of changes to Part 61 personnel licensing requirements that address issues of pilot training.

The rule amendments in this NPRM propose that all flight training and assessment that is required by Part 61 for the issue of a pilot licence or rating be undertaken by a person operating under the authority of an aviation training organisation certificate issued in accordance with Part 141 or under the authority of a Part 119 or 137 certificate. Amendments are proposed to Part 141 to amend the current aviation training organisation requirements and establish four types of training organisation certificate consisting of:

  • Aviation Training Organisation certificate for all Part 61 pilot licence and rating training including Biennial Flight Reviews. This certificate also covers flight tests and assessments required under Part 61.

  • Flight Training Organisation certificate for conducting private pilot licence, type rating and aerobatic rating training. This certificate also covers the Biennial Flight Reviews.

  • Special Training Organisation certificate for specialist training including dangerous goods training and security training.

  • Restricted Training Organisation certificate for a single, specific period training course.

Part 61 is amended to require that a person holding a flight instructor rating issued in accordance with Part 61 can only exercise the privileges of a flight instructor rating under the authority of a holder of a Part 141 training certificate, Part 119 Air operator certificate, or Part 137 agricultural certificate. Additionally, any ground based training or assessment required under Part 61 must be conducted by an organisation holding a training organisation certificate issued in accordance with Part 141, 119 or 137.

  • Part 121—Air Operations – Large Aeroplanes
  • Part 125—Air Operations – Medium Aeroplanes
  • Part 135—Air Operations – Helicopters and Small Aeroplanes.
  • Part 141—Training Organisation – Certification

Telecommunications Act 2001

Notification of Approval of the Telecommunications Carriers’ Forum Draft Code for Co-location of Radiocommunications Services Regulated Under the Telecommunications Act 2001

On 7 December 2006, the Commerce Commission (“Commission”), pursuant to Schedule 2 of the Telecommunications Act 2001 (“the Act”), approved the Telecommunications Carriers’ Forum Draft Code for Co-location of Radiocommunications Services Regulated under the Telecommunications Act 2001 (“The Co-location Code”).

Copies of the Co-location Code and the decision to approve the code are available on the Commission’s web site at:

Pursuant to clause 16 of Schedule 2 of the Act, the Commission gives public notice of its approval.
