Dear Roy
As discussed, I would like you to finish your time as a member and chair of the Electricity Commission on 30 November 2006. This letter sets out the situation in terms of the Crown Entities Act 2004.
I will shortly be commencing a process to appoint your successor, however to provide you certainty, this letter constitutes written notice that you will cease to be a member of the Electricity Commission in accordance with section 36 (1) of the Crown Entities Act 2004 (“the Act”) with effect from 30 November 2006.
As you are aware, your term as a member and as chair of the Electricity Commission expires on 14 September 2006. In accordance with section 32 of the Act, your term as member continues despite expiry. Section 45 (b) of the Act provides that a member ceases to hold office when the member is removed from office. In accordance with clause 2 (d) of Schedule 5 of the Act, your term as chair is extended until 30 November 2006.
Therefore, with effect from 30 November 2006 you will cease to be a member of the Electricity Commission and your term as chair will cease at that time in accordance with clause 2 (c) of Schedule 5 of the Act.
I would like to take this opportunity to express my sincere appreciation for all that you have done since you took up your appointment in September 2003.
When you arrived in New Zealand there was nothing in place and now under your stewardship we have a fully functioning Commission which has tackled a very heavy workload.
In accordance with section 36 (2) of the Act a copy of this letter has been provided to the Electricity Commission.
A copy of the letter will also be published in the New Zealand Gazette in accordance with section 36 (4).
I wish you well for the future.
