Land and Easement Acquired for Water Treatment Plant—State Highway No. 2, Katikati, Western Bay of Plenty District

Pursuant to the Public Works Act 1981, and to a delegation
from the Minister for Land Information, Ronald Alistair
Jolly, Land Information New Zealand:

(a) Pursuant to section 20, declares that, an agreement
to that effect having been entered into, the land described in
the First Schedule to this notice is hereby acquired for water
treatment plant, subject to B664262.2, H845068 and
B020105.10, and shall vest in the Western Bay of Plenty
District Council on the date of publication of this notice in
the New Zealand Gazette.

(b) Pursuant to sections 20 and 28, declares that, an
agreement having been entered into creating:

(i) Right of way with the rights and powers set out in
paragraphs 6 and 10 to 14 inclusive of Schedule 4 of
the Land Transfer Regulations 2002;

(ii) Right to convey water together with the rights and
powers set out in paragraphs 3 and 10 to 14 inclusive
of Schedule 4 of the Land Transfer Regulations
2002, except that the words "in common with the
grantor and other persons to whom the grantor may
grant similar rights" in paragraph 3 (i) shall be
deleted;

(iii) Right to convey electricity together with rights and
powers set out in paragraphs 7 and 10 to 14 inclusive
of Schedule 4 of the Land Transfer Regulations
2002, except that the words "as agreed by the
grantor at the time of installation of the facility" in
paragraph 7 (3) shall be deleted

are hereby acquired over the land described in the Second
Schedule to this notice and shall vest in the Western Bay of
Plenty District Council on the date of publication of this
notice in the New Zealand Gazette.
