Notice of Making of a Recommendation
Concerning the Electricity Governance Rules –
Rule Amendment Proposal No. 50

Maritime Safety Authority of
New Zealand

This notice of a recommendation concerning the Electricity
Governance Rules 2003 (“Rules”), Rule Amendment
Proposal No. 50, is issued by the Electricity Commission
(“Commission”), established under the Electricity Act
1992 (“Act”), pursuant to section 172E (2) (c) of that Act.

Maritime Transport Act 1994

Section 172E (2) (c) provides that, no later than 10 working
days after making a recommendation concerning the Rules
to the Minister of Energy, the Commission must publicise
the recommendation and the assessment completed under
section 172F of the Act.

Recommendation

The Commission made a recommendation that the table of
contents of Code of Practice D3, Schedule D1 of Part D
of the Rules, be amended in reliance on section 172F (3) on
11 January 2005.

Section 172F (3) provides that the Commission is not
required to comply with section 172F (1) if it is satisfied
that the effect of the recommendation is minor and will not
adversely affect the interests of any person in a substantial
way. Accordingly, no such assessment has been carried out.

Recommended Amendment to the Rules

The recommended amendment is for the removal of the
references to Appendix 2 and Appendix 3 (minimum
requirements for meter calibration and testing, and statistical
sampling methodology), which do not exist and are not
otherwise referenced, in the table of contents of Code of
Practice D3, Schedule D1, of Part D of the Rules.

Authority hereby determines that the following are new
organisms:

Notification of Permanent Speed Uplifting Under
Part 91 of the Maritime Rules

Pursuant to Rule 91.20 of the Maritime Rules, made
pursuant to the Maritime Transport Act 1994, I, Peter
Williams, Acting Director of Maritime Safety, hereby grant
a permanent uplifting of the speed limit prescribed by Rule
91.6 on Lake Opunake, subject to the following conditions:

  1. This uplifting applies only to the 5-knot restriction
    within 200 metres of the shore. All other requirements
    of Part 91 remain in force.

  2. The permanent uplifting applies between sunrise and
    sunset on Sundays, Mondays and Thursdays.

Pursuant to section 14 (5) of the Forest and Rural Fires Act
1977, the National Rural Fire Authority hereby makes the
following notice.

Notice

  1. (1) This notice is the Department of Conservation
    Wanganui Conservancy Fire Safety Margin Removal Notice
    2005*.

(2) This notice will come into force on 1 January 2005.

  1. The one kilometre fire safety margin is hereby removed
    from the following land parcels:

Hartleys Conservation Area:
Part Ruatangata, and part Ruangata 1B4F1 and Crown
land adjoining part Ruatangata 1B4F1.

Longacre Conservation Area:
Part Section 350, Left Bank Wanganui River.

Kakatahi Conservation Area:
Sections 7-13, Block XIV, Ngamatea Survey District.

Raukawa Scenic Reserve:
Section 2, Block X, Ngamatea Survey District.

Otoko Scenic Reserve:
Section 11, Block II, Mangawhero Survey District.

Manawanui Scenic Reserve:
Section 5, Block XI and Section 14, Block XV,
Ngamatea Survey District.

Hales Road Scenic Reserve:
Section 50, Block IV, Mangawhero Survey District.

Patea Harbour Conservation Area:
Crown land adjoining Lot 1, DP 33878, situated in
Block X, Wairoa Survey District.
