Forest and Rural Fires Act 1977

Western Bay Moana Rural Fire District Constitution and Administration Notice 2004

Pursuant to sections 4 (1) and 8 (1) of the Forest and Rural Fires Act 1977, the National Rural Fire Authority hereby makes the following notice.

Notice

1. Title and commencement—(1) This notice is the Western Bay Moana Rural Fire District Constitution and Administration Notice 2004.

(2) This notice comes into force 28 days after publication in the New Zealand Gazette.

2. Constitution of the Western Bay Moana Rural Fire District—The areas set out in the Schedule to this notice are hereby constituted and declared to be a rural fire district to be known as the Western Bay Moana Rural Fire District.

3. Constitution of the Western Bay Moana Rural Fire Committee—The Western Bay Moana Rural Fire District Committee is hereby constituted as a rural fire committee.

4. Administration of the Western Bay Moana Rural Fire District—(1) For the purposes of the Forest and Rural Fires Act 1977, the Western Bay Moana Rural Fire District shall be administered by the Western Bay Moana Rural Fire District Committee.

(2) The committee shall consist of six members as follows:
(a) Three persons appointed, in writing, by the Western Bay of Plenty District Council; and
(b) one person appointed, in writing, by the Tauranga District Council; and
(c) one person appointed, in writing, by the Minister of Local Government; and
(d) one person appointed, in writing, by the Department of Conservation under the signature of its Director General.

Schedule

(1) All those parcels comprising the areas delineated on S.O. Plan 332125 (South Auckland Land District) deposited with Land Information New Zealand, titled “Western Bay Moana Rural Fire District”.

(2) Excluded from the Western Bay Moana Rural Fire District are all “fire districts” as defined in section 2 of the Fire Service Act 1975.

Amendment to a Notice—Declaring Land to be Held for Conservation Purposes

Pursuant to section 50A of the Conservation Act 1987, the Community Relations Manager of the West Coast Conservancy of the Department of Conservation hereby amends the notice dated the 8th day of December 2003, Declaring Land to be Held for Conservation Purposes, published in the New Zealand Gazette, 11 December 2003, page 4686, by omitting from the description of the land in the Schedule the area

"2143 square metres, more or less,"

and substituting the area

"2342 square metres, more or less,"

Declaring the Disposition of Land to be Exempt From Section 24 of the Conservation Act 1987

Under section 24B (4) (b) of the Conservation Act 1987, the Minister of Conservation declares that the marginal strip requirements set out in section 24 of the Act shall not apply to the disposition of the land required in connection with electricity works as the Maraetai Power Station specified in the Schedule hereto.

Land Acquired for Road—52 Hepburn Creek Road, Warkworth

Pursuant to section 20 (1) of the Public Works Act 1981, and to a delegation from the Minister for Land Information, Stephen Robert Gilbert, Land Information New Zealand, declares that, an agreement to that effect having been entered into, the land described in the Schedule to this notice is hereby acquired for road and is vested in the Rodney District Council on the date of publication of this notice in the New Zealand Gazette.
