Energy Efficiency (Amendments to Incorporated Material) Notice 2004

Pursuant to the Energy Efficiency and Conservation Act 2000, the Minister of Energy gives the following notice.

Notice

  1. Under section 37(4) of the Energy Efficiency and Conservation Act 2000, I give notice that the following amendment to the following standard, which is listed in Schedule 1 of the Energy Efficiency (Energy Using Products) Regulations 2002, is part of the Regulations:

Amendment No. 1 (2004) to NZHB 4783.2:2001 Performance of electrical lighting equipment – Ballasts for fluorescent lamps – Energy labelling and minimum energy performance standard (MEPS) requirements.

  1. This amendment takes effect as part of the Regulations on 1 February 2004.

Explanatory Note

The Energy Efficiency (Energy Using Products) Regulations 2002 incorporate by reference certain standards. The standard incorporated by reference that relates to the performance of electrical lighting equipment – ballasts for fluorescent lamps has been amended. This notice specifies the date upon which the amendment to the standard takes effect as part of the Regulations.

Hazardous Substances and New Organisms Act 1996

Determination of Hazardous Substances

Pursuant to section 26 of the Hazardous Substances and New Organisms Act 1996 (“the HSNO Act”), the Environmental Risk Management Authority hereby determines the following substances are not hazardous:

Expandable polystyrene (EPS) beads are defined as solid polymers comprising a minimum of 91% polystyrene (CAS number 9003-53-6) and a maximum of 9% of any of the blowing agents listed below, in any combination:

  • n-pentane, CAS number 109-66-0
  • cyclopentane, CAS number 287-92-3
  • isopentane, CAS number 78-78-4
  • Butane, CAS number 106-97-8
  • isobutane, CAS number 75-28-5
  • Propane, CAS number 74-98-6

EPS beads are not intended for sale to the general public. They will generally only be available in the workplace, specifically plastic manufacturers. Thus, although it is recognised that the blowing agents in the beads may out-gas to produce vapours with some risks (e.g. flammability, health risks via inhalation), it is acknowledged that such risks will be managed by legislation other than the HSNO Act, i.e. the Land Transport Rule: Dangerous Goods 1999 (Rule 45001 under the Land Transport Act 1998) and the Health and Safety in Employment Act 1992.

Pursuant to section 166(3) of the Land Transport Act 1998, I, John Glyde Kay, General Manager, Operations, Land Transport Safety Authority, notify the following exemptions from Land Transport Rules were made under section 166(1) of that Act between 1 October 2003 and 31 December 2003:
