Civil Aviation Rules—Notification of Ordinary Rules

In accordance with section 34 (1) (a) of the Civil Aviation Act 1990, the Minister of Transport hereby gives notice of his intention to make ordinary rules in the following Civil Aviation Rule (CAR) Parts:

Part 108—Air Operator Security Programme – amendments to Part 108 in regard to Hold Baggage Screening and Hold Baggage Authorisation to implement the ICAO Annex 17 requirements (NPRM 05-03, Docket 4/CAR/10).

Part 1—Definitions and Abbreviations – amendments to Part 1 to add new definitions related to baggage.

Comments on the proposed rules should be submitted to the Docket Clerk by 18 February 2005.

The Notice of Proposed Rule Making (NPRM) is available on the CAA web site:

Airworthiness Directive

Pursuant to section 72I (3A) of the Civil Aviation Act 1990, I, John Douglas Stanton, Continuing Airworthiness Specialist, acting under a delegation from the Director of Civil Aviation, hereby issue the following airworthiness directive in respect of an aircraft or an aeronautical product:

This airworthiness directive shall come into force on 23 December 2004.

Electricity Industry Reform Act 1998

Notice of Temporary Exemption—Multiplex Group

The Commission, pursuant to section 81 of the Electricity Industry Reform Act 1998 (“EIR Act”), temporarily exempts the following entities from the application of section 17 of the EIR Act in respect of their potential “cross-involvements” (as that term is defined in the EIR Act) which may result from the purchase of the South City Shopping Centre by Multiplex Funds Management Limited:

  • Multiplex Albert Street Landowning Trust;
  • Multiplex Albert Street Investment Trust;
  • Multiplex Albert Street Landowner Pty Limited;
  • Multiplex Albert Street Investment Pty Limited;
  • Multiplex Funds Management Limited;
  • Multiplex Limited;
  • Multiplex Capital Limited;
  • Multiplex Property Trust;
  • Multiplex New Zealand Property Fund;
  • Multiplex Tasman Property Fund;
  • Roberts Family Nominees Limited;
  • Acumen Property Securities Fund;
  • Acumen Capital Securities Limited;
  • SPB Developments Pty Limited;
  • Selangor Properties Berhad and its shareholders; and
  • Hyde Park Management Limited and its shareholders.

This temporary exemption takes effect from the date of publication until:

  • a permanent exemption takes effect, in the event that the Commission grants a permanent exemption; or
  • three months after the date of the release of the Commission’s determination, if the Commission declines to grant a permanent exemption.

The Commission may vary or revoke this temporary exemption at any time in accordance with section 81 (5) of the EIR Act.

The temporary exemption takes effect from the date of publication of this notice in the New Zealand Gazette.
