Terms and Conditions

1. The grantee shall have the right:
   (i) To forever take, convey and lead electricity reticulation in a free and unimpeded flow from the source of supply or point of entry in, along and through the easement land.

   (ii) To lay, inspect, maintain, repair or re-lay electricity cable under the ground of the easement land (and over the ground of the easement land as hereinafter provided) any associated fixtures and fittings as may be reasonably required for the supply of power for lighting to the truck weighing station on State Highway No. 1. Notwithstanding the foregoing, the easement shall be confined to underground cables buried at least 600mm deep from the truck weighing station to the pole on the easement land and by overhead cables from the pole on the easement land to the transformer.

   (iii) To enter upon the servient land for the purpose of inspecting, maintaining, re-laying, repairing, replacing or altering the electricity cabling and fixtures and fittings, as the case may be, and opening up the soil of the easement land making any cuttings, trenches and fillings, and to reopen the same, and generally to do and perform such acts or things upon the easement land as may be necessary to enable the grantee to receive the full use and enjoyment of the rights and privileges granted to the grantee.\n

2. The grantee will make good any damage to the servient land including without limitation reinstating all fencing, driveways and areas of garden and lawns to a similar standard to that which exists immediately prior to the exercise of the grantee’s rights pursuant to this easement.

Land Acquired for Road—139 to 145 Fendalton Road, Christchurch City

Pursuant to section 20 (1) of the Public Works Act 1981, and to a delegation from the Minister for Land Information, Ronald Alistair Jolly, Land Information New Zealand, declares that, an agreement to that effect having been entered into, the land described in the Schedule to this notice is hereby acquired for road and is vested in the Christchurch City Council on the date of publication hereof in the New Zealand Gazette.

Notice of Intention to Take Land for Road—East Coast Road, Redvale, Parish of Okura

Pursuant to section 23 of the Public Works Act 1981, notice is hereby given that the Rodney District Council (“the council”), proposes to take the land described in the Schedule hereto (“the land”):

• The land has been formally designated as road (“the PENLINK roading project”) in accordance with the designation decision dated 18 December 1998, subject to the Consent Orders of the Environment Court dated 27 February 2001.
• The intended taking will enable the council to proceed with construction of the PENLINK roading project.
• The owners of the land and those persons with a registered interest in it have been served with notice of the council’s intention to take the land and advised of their right to object.

Any other person having the right to object may send a written objection to the Registrar, Environment Court, Tribunals Division, Department for Courts, P.O. Box 5027, Wellington, within 20 working days after the date of publication of this notice.

If any objection is made in accordance with this notice, a public hearing will be held. The objector will have the right to appear and be heard personally unless the objector otherwise requires. Each objector will be advised of the time and place of the hearing.

All that piece of land containing 31.8997 hectares, being Sections 1, 2 and 3 on S.O. Plan 70765, being parts Lot 1, D.P. 95984 and being part Allotment 1, Parish of Okura. Part certificate of title 80D/150, North Auckland Land Registry.

The land to be taken is situated at 1695-1697 East Coast Road, Redvale.

Copies of the plans may be viewed at the offices of the Rodney District Council, 50 Centreway Road, Orewa.
