(2) In this Amendment, the Direction in Relation to Special Benefit is called "the direction".

  1. Commencement—This Amendment comes into effect on 1 July 2001.

  2. Amendments consequential on abolition of Disability Assistance Programme and enactment of New Zealand Public Health and Disability Act 2000—(1) Clause 1.4 of the direction is amended by omitting from paragraph (d) of the words "Health and Disability Services Act 1993" and substituting the words "New Zealand Public Health and Disability Act 2000".

(2) The definition in clause 2.1 of the direction of allowable costs is amended:

(a) by omitting from paragraph (c) the words "or a disability assistance payment would be made under section 124 (1) (d) of the Act,";

(b) by omitting from paragraph (c) the words "or a disability assistance payment".

  1. Amendments consequential upon Part 3 of the Social Security Amendment Act 2001 coming into force on 1 July 2001—(1) The direction is amended in the manner set out in Schedule 1.

(2) The Schedule of the direction is amended in the manner set out in Schedule 2.

Consequential Amendments to the Direction

Clause 2.1

Omit from paragraph (a) of the definition of chargeable income the words "any of sections 115 to 118" and substitute the words "section 117".

Omit from the definition of grand-parented rate the words "community wage" and substitute the words "sickness benefit".

Omit from that definition the expression "99 (2)" and substitute the expression "54D (2)".

Omit from paragraph (b) of the definition of standard costs the words "a community wage" and substitute the words "an unemployment benefit".

Clause 3.1

Omit from the example following this clause the words "community wage earner", and substitute the words "unemployment beneficiary".

Clause 3.2

Omit the words "community wage" and substitute the words "unemployment benefit".


Schedule 2

Clause 4 (2)

Consequential Amendments to the Schedule of the Direction

Clause 1

Omit the words "a community wage" and substitute the words "an unemployment benefit or a sickness benefit".

Clause 2

Revoke.

Clause 6

Omit the words "community wage on the grounds of sickness, injury or disability" and substitute the words "sickness benefit".

Clause 11

Omit the words "community wage on the grounds of sickness, injury or disability" and substitute the words "sickness benefit".

Clause 12

Omit the words "a community wage" and substitute the words "an unemployment benefit or a sickness benefit".

Clause 14

Omit the words "community wage" where they first appear and substitute the words "sickness benefit".

Omit the words "a community wage at" and substitute the words "an unemployment benefit or a sickness benefit at".

Clause 15

Omit the words "community wage" and substitute the words "sickness benefit".

Clause 16

Omit the words "a community wage" and substitute the words "an unemployment benefit or a sickness benefit".

Clause 17

Omit the words "community wage" and substitute the words "sickness benefit".


Telephone Costs Payment Amendment 2001

Pursuant to section 124 (1) (d) of the Social Security Act 1964, the Minister of Social Services and Employment establishes and approves the following Amendment to the Telephone Costs Payment Programme (as established and approved on 28 March 1999).

Amendment

  1. Title—(1) This Amendment is the Telephone Costs Payment Amendment 2001.

(2) In this Amendment, the Telephone Costs Payment Programme is called "the programme".

  1. Commencement—(1) This Amendment comes into effect on the day after the date on which it is published in the New Zealand Gazette.

  2. Amendments consequential on abolition of the Disability Assistance Programme—(1) Clause 6.1 of the programme is amended by omitting the words "or a payment under the Disability Assistance Programme under section 124 (1) (d) of the Act".

(2) Clause 7.2 of the programme is amended by omitting from paragraph (a) the words "or ceases to be eligible to receive a payment under the Disability Assistance Programme".

  1. Revocation—The Telephone Costs Payment Amendment (No 1) is revoked.

Direction on Advance Payment of Benefits Amendment (No 2) 2001

To: The Chief Executive of the Department of Work and Income.

Pursuant to section 5 of the Social Security Act 1964, the Minister of Social Services and Employment makes the following Amendment to the Direction on Advance Payment of Benefits given on 25 May 1999.
