The Education (Domestic Students) Notice 2001

Pursuant to section 2 (1) paragraph (e) of the definition of the term “domestic student” and section 4A (1) of the Education Act 1989, the Minister of Education, by and through the Senior Manager, National Operations, Ministry of Education, acting under delegated authority, gives the following notice.

Notice

  1. Title and commencement—(1) This notice may be cited as the Education (Domestic Students) Notice 2001.

(2) This notice shall come into force on the day after the date of its publication in the New Zealand Gazette.

  1. Persons to be treated as if they are not foreign students—For the purposes of Parts I to III, and section 79 (2) of the Education Act 1989, foreign students of the following kind, class, or description are persons who are required to be treated as if they are not foreign students and who are entitled to enrol at State schools:

(a) A foreign student who is in New Zealand to study under an exchange programme approved by the New Zealand Government;

(b) A foreign student who is the dependent child of any person who is in New Zealand to study under an exchange programme approved by the New Zealand Government;

(c) A foreign student who is the dependent child of any person who is the holder of an unexpired work permit granted in accordance with the Immigration Act 1987;

(d) A foreign student who was enrolled at a registered school in New Zealand before 1 January 1989, and who has been continuously enrolled at 1 or more registered schools in New Zealand since that date and who meets the requirements of the Immigration Act 1987, for undertaking a course of study or training in New Zealand;

(e) A foreign student who is the dependent child of any person who, during the current calendar year, last ceased to be exempt, under section 11 (1) (a) of the Immigration Act 1987, from the requirement to hold a permit under that Act.

(f) A foreign student who is the dependent child of any person who is the holder of a Commonwealth scholarship; and

(g) A foreign student who has, or who is the dependent child of any person who has, made a claim to be recognised as a refugee in accordance with Part VIA of the Immigration Act 1987.

  1. Revocations—This notice revokes the following notices:

(a) The Education (Fees Exemption for Dependents of Exchange Students) Notice 1990, published in the New Zealand Gazette, 8 November 1990, No. 195, page 4256.

(b) The Education (Domestic Students’) Notice 1998, published in the New Zealand Gazette, 12 February 1998, No. 26, page 566.

(c) The Amendment to the Education (Domestic Students’) Notice 1998, published in the New Zealand Gazette, 10 September 1998, No. 140, page 3409.

Private Schools Conditional Integration Act 1975

Supplementary Integration Agreement

Pursuant to section 10 of the Private Schools Conditional Integration Act 1975, notice is given that a supplementary integration agreement has been signed between the Minister of Education on behalf of Her Majesty the Queen, acting through the Senior Manager, National Operations, Ministry of Education, pursuant to delegated authority, and the proprietor of the following school:

St Mary’s Primary School, Hastings.

The said supplementary integration agreement was executed on the 23rd day of January 2001.

A copy of the supplementary integration agreement is available for inspection without charge by any member of the public at the district office of the Ministry of Education, 65 Waterloo Road, Lower Hutt.
