Fisheries (Quota Aggregation Limit Exemption) Notice 2001 (No. F170)
Pursuant to section 28W (3) of the Fisheries Act 1983, the Minister of Fisheries, after consultation with the New Zealand Fishing Industry Board and the Treaty of Waitangi Fisheries Commission and after having regard to the provisions of section 28W (5) of the Fisheries Act 1983, hereby gives the following notice:

Title and Commencement
(a) This notice may be cited as the Fisheries (Quota Aggregation Limit Exemption) Notice 2001.
(b) This notice shall come into effect on the day after its notification in the New Zealand Gazette.

Exemption to quota aggregation limit—As from the date this notice comes into effect, for the purposes of section 28W (3) (b), Motupipi Fishing Company Limited may hold quota and interest in quota up to and including a limit of 12.48% of the Total Allowable Commercial Catch for spiny rock lobster in quota management area CRA9.

Fisheries (South Island Customary Fishing) Regulations 1999
Fisheries (South Island Customary Fishing) Notice (No. 25) 2000 (No. F169)
Pursuant to Regulation 10 of the Fisheries (South Island Customary Fishing) Regulations 1999, the Minister of Fisheries hereby gives the following notice.

Title and commencement—(1) This notice may be cited as the Fisheries (South Island Customary Fishing) Notice (No. 25) 2000.
(2) This notice shall come into effect the day after the date of its notification in the New Zealand Gazette.

Interpretation—In this notice:
(a) The term “Customary food gathering” has the same meaning as defined in the Fisheries (South Island Customary Fishing) Regulations 1999.
(b) Any reference to “Tāngata Tiaki/Kaitiaki” means the person or persons appointed, under Regulation 9 or 10 of the Fisheries (South Island Customary Fishing) Regulations 1999, as Tāngata Tiaki/Kaitiaki for the area/rohe moana.
(c) Any reference to areas/rohe moana means the areas from the Clarence River to the Gore Bay peninsula and from the Gore Bay peninsula to the Hurunui River; inland to the boundaries defined for Te Rūnanga o Kaikōura in the Te Rūnanga o Ngāi Tahu Act 1996; extending seaward from each point in an easterly direction to the limit of the South Island fisheries waters as defined under Regulation 2 of the Fisheries (South Island Customary Fishing) Regulations 1999, being the 200 mile limit; returning to the first mentioned point.

Cancellation of Tāngata Tiaki/Kaitiaki—Riwai Pacey as Tāngata Tiaki/Kaitiaki for the area/rohe moana, under Regulation 5 of the Fisheries (South Island Customary Fishing) Regulations 1999, has requested in writing the cancellation of his appointment as Tāngata Tiaki/Kaitiaki.

Cancellation of Appointment—The Minister of Fisheries hereby cancels the appointment of Riwai Pacey as Tāngata Tiaki/Kaitiaki for managing customary food gathering for the areas/rohe moana.

Nomination of Tāngata Tiaki/Kaitiaki—Te Rūnanga o Kaikōura, being the Tāngata Whenua holding manawhenua manamoana over the area/rohe moana, have nominated Raymond Giovanni Maru Jacobs as Tāngata Tiaki/Kaitiaki for the area/rohe moana.

Appointment of Tāngata Tiaki/Kaitiaki—The Minister of Fisheries hereby appoints Raymond Giovanni Maru Jacobs as Tāngata Tiaki/Kaitiaki for managing customary food gathering for the areas/rohe moana. The appointment is for a term of 5 years commencing the day this notice comes into effect.

Power to authorise taking of fisheries resources for customary food gathering—The Tāngata Tiaki/Kaitiaki may authorise any individual to take fisheries resources managed under the Fisheries Acts 1983 and 1996 for customary food gathering purposes from within the whole or any part of the areas/rohe moana. No customary food gathering of fisheries resources may take place in the areas/rohe moana without authorisation from the Tāngata Tiaki/Kaitiaki.
