Pursuant to section 55 of the Public Works Act 1981, and to a delegation from the Minister of Lands, Kerry John Twydle, Land Information New Zealand, hereby amends the notice dated 2 September 1999, declaring land to be set apart for railway purposes, published in the New Zealand Gazette of 9 September 1999, No. 114 at page 2743 and registered as D. 431189.1 in the North Auckland Land Registry, by inserting in the description after the words “Eccleston No. 2 West Settlement” the words “, and part Lot 3, D.P. 26416”, and by inserting after the words “part Proclamations 6355” the words “, 9997”.

Westland District Council

Revocation of Notice—Hokitika Aerodrome

In the matter of Public Works Act 1981 and in the matter of Hokitika Aerodrome:

Whereas the Westland County Council, the local authority having control of the Hokitika Aerodrome, by notice in the New Zealand Gazette, No. 23, page 1830 of 12 August 1937, pursuant to section 4 of the Public Works Amendment Act 1935, prohibited limited or restricted the use of the lands described therein to the extent therein described and whereas by virtue of an Order in Council dated the 9th day of June 1989, made pursuant to the Local Government Act 1974, the Westland District Council assumed the powers, functions and obligations of the Westland County Council, and whereas the provision of the Public Works Act 1981, corresponding to section 4 of the Public Works Amendment Act 1935, namely section 187, was repealed by the Resource Management Act 1991, without providing any substituted procedures so that the provisions of the Interpretation Act 1999, saving the said section are applicable thereby enabling
