(a) The council will at its own cost repair any damage to the land, fences, water supply, drainage or other improvements contained in the balance of the land comprised and described in certificate of title 24C/564, which has been caused exclusively by the council while exercising its rights and powers under this easement.

(b) The council shall be entitled at its own cost to form and from time to time upgrade and maintain the said right of way to such a standard as is suitable for the council’s requirements.

Land Together With a Right of Way Easement to be Acquired for a Public Work (Water Works) at Campbells Road, Makerua and Vested in the Manawatu–Wanganui Regional Council

Pursuant to sections 20 (1) and 28 of the Public Works Act 1981, and to a delegation from the Minister of Lands, R. J. Sutherland, Land Information New Zealand, declares that, pursuant to an agreement to that effect having been entered into, the land described in the First Schedule hereto is hereby acquired for a public work (water works) and is vested in the Manawatu–Wanganui Regional Council, together with an appurtenant right of way easement in terms of the Seventh Schedule of the Land Transfer Act 1952 over the land described in the Second Schedule hereto and such easement to be subject to the additional conditions as set out in the Third Schedule hereto on the date of publication of this notice in the New Zealand Gazette.

(a) The council shall be entitled at its own cost to form and from time to time upgrade and maintain the right of way described in the Second Schedule to such a standard as is suitable to the council’s requirements, provided that any such proposed work shall first be approved in writing by the registered owner of the land described in the Second Schedule, and such approval shall not be unreasonably or arbitrarily withheld.

(b) Should the registered owner of the land described in the Second Schedule or their agents be using the right of way for stock movement purposes, the council will not use the right of way until the stock are cleared from the right of way area.

Road Realignment—State Highway No. 6 at Owen River

Pursuant to the Public Works Act 1981, and to a delegation from the Minister of Lands, R. J. Sutherland, Land Information New Zealand:

(a) Pursuant to section 114, declares the land described in the First Schedule of this notice to be road which, pursuant to section 60 (2) of the Transit New Zealand Act 1989, shall form part of State Highway No. 6 and shall remain vested in the Crown.

(b) Pursuant to sections 116 and 117, declares the road described in the Second Schedule of this notice to be stopped and further declares that the stopped road shall be added to the Owen River Scenic Reserve. All Gazette Notice 402245.1 (Nelson Registry).
