(a) Pursuant to section 52 (1), declares that the land described in the First Schedule to this notice to be set apart for road which, pursuant to section 88 (2) of the Transit New Zealand Act 1989, becomes road, limited access road and State highway and shall remain vested in the Crown on the date of publication of this notice in the New Zealand Gazette.

(b) Pursuant to section 20 (1), declares that, pursuant to an agreement to that effect having been entered into, the land described in the Second Schedule to this notice is acquired for road which, pursuant to section 88 (2) of the Transit New Zealand Act 1989, becomes road, limited access road and State highway and shall vest in the Crown on the date of publication of this notice in the New Zealand Gazette.

Easement Acquired for Police, Public Safety and Emergency Services Radio Communications and Telecommunications Purposes—Waimahora Road, Otorohanga

Pursuant to sections 20 and 28 of the Public Works Act 1981, and to a delegation from the Minister of Lands, R. J. Sutherland, Land Information New Zealand, declares that, pursuant to an agreement to that effect having been entered into and varied by agreement dated 5 September 1996, a right to operate a telecommunications easement in gross (in common with the owner and any other lawful users) in perpetuity, from 8 March 1995 (called “the commencement date”) and for the sum of $17,500.00 plus G.S.T., is acquired over the land owned by Arthur Blair Cowan (called “the grantor”), described in the First Schedule to this notice, for the rights described in the Second Schedule to this notice, on the terms and conditions described in the Third Schedule to this notice, and is vested in the Crown (called “the grantee”) for communications for police, public safety and emergency services radio communications and telecommunications purposes of this notice in the New Zealand Gazette.
