Notice of Request for Removal of the Company From the New Zealand Companies Register

Take notice that the shareholders of Tanner Fitzgerald Getty Nominees Limited (“the company”) will deliver to the Registrar of Companies a request that the company be removed from the New Zealand Register, pursuant to section 318 (1) (d) of the Companies Act 1993 (“the Act”) and on the grounds specified in section 318 (2) (a) of the Act, namely, that the company has ceased to carry on business, has discharged in full its liabilities to all its known creditors and has distributed its surplus assets in accordance with its constitution and the Act.

Any objection to the removal of the company from the New Zealand Register, under section 321 of the Act, must be delivered to the Registrar on or before the 27th day of May 1999.

Notice is hereby given in pursuance of section 320 of the Companies Act 1993, that:

(a) It is intended that the above-named company be removed from the Register under section 318 (1) (e), on the grounds that the duties of the liquidator have been completed and the liquidator has sent to the Registrar, the documents referred to in section 257 (1) (a) of the Act.

Pursuant to section 318 (1) (e) of the Companies Act 1993, and subsequent to the liquidations of the above-named companies having been completed, I, Leonard Smith, business consultant of Pakuranga as the liquidator, hereby gives notice that I propose to apply to the Registrar of Companies for removal of the above companies from the Register, pursuant to section 318 (2) (a) of the Companies Act 1993.

Unless written objection is made to the District Registrar of Companies, Private Bag 92-513, Wellesley Street, Auckland 1036, within 28 days of the publication of this notice, the Registrar may remove the companies from the Register.

Notice is also given pursuant to section 120 of the Companies Act 1993, that a general meeting of shareholders of the above-mentioned companies will be held in the offices of Fletcher Challenge Nominees Limited, Level Five, Fletcher Challenge House, Penrose, Auckland, on the 28th day of May 1999 at 10.00 a.m.
