(i) The service brake shall incorporate a dual circuit braking system from the service brake foot valve (brake pedal) to the road wheels;

(ii) The parking brake must be capable of holding the fully laden vehicle while facing both up or down hill on a gradient of 1 in 5 for an indefinite time;

(iii) Prospective vehicle owners must be fully informed of this notice and the conditions contained within;

(iv) This vehicle shall hold a current certificate of fitness, pursuant to regulation 84 of the Traffic Regulations 1976;

(v) This exemption may be revoked at any time;

(vi) A copy of this notice must be carried in the vehicle at all times and be readily available for inspection.

Exemption From Specified Requirements of the Transport (Vehicle Standards) Regulations 1990

Declaration Under the Submarine Cables and Pipelines Protection Act 1996

Whereas, pursuant to section 441 of the Maritime Transport Act 1994, the Minister of Transport did delegate those powers under section 12 (6) of the Submarine Cables and Pipelines Protection Act 1996 to the Maritime Safety Authority by an Instrument of Delegation dated 19 March 1997.

And whereas, pursuant to section 442 of the Maritime Transport Act 1994, the Maritime Safety Authority did delegate those powers under section 12 (6) of the Submarine Cables and Pipelines Protection Act 1996 to me by an Instrument of Delegation dated 26 March 1997.

Therefore I, Russell Paul Kilvington, Director of Maritime Safety, hereby make the following declaration:

Declaration

The Order in Council under section 12 of the Submarine Cables and Pipelines Protection Act 1996, entitled the Submarine Cables and Pipelines Protection Order 1992, shall not apply in respect of the following ships:

Pacific Chieftain

Any other ship contracted by ALCATEL Submarine Networks Pry Limited and workboats, zodias and small craft associated with those ships whilst working in the protected area designated “Area 5–Muriwai Beach” for the purpose of installing the Southern Cross Cable Network for the period from 26 to 30 April 1999 or for the period required to complete the work.

This notice comes into effect on and from the 23rd day of April 1999.
