Access Land

Those parts of Lots 1 and 2, D.P. 2463, being the balance of certificate of title 421/141.

Terms

  1. The Crown, its employees and invitees (but not including the general public) may enter the access land off Buller Road, for the purpose of gaining access to the land acquired in the First Schedule.

  2. The Crown shall use its best endeavours to give the registered proprietor of the access land at least 24 hours notice before entering the access land. The Crown shall have regard to the owner’s wishes as to the route to be followed and mode of transport to be adopted.

Land Set Apart for Road and Road to be Stopped and Amalgamated—State Highway No. 6, Whangamoa Deviation, Nelson City

Pursuant to the Public Works Act 1981, and to a delegation from the Minister of Lands, Kerry John Twydle, Land Information New Zealand:

(a) Pursuant to section 52 (1), declares that the land described in the First Schedule to this notice is set apart for road which, pursuant to section 60 (2) of the Transit New Zealand Act 1989 forms part of State Highway 6.

(b) Pursuant to section 116 (1), declares the portion of road described in the Second Schedule to this notice to be stopped and further declares pursuant to section 52 (1) shall be set apart for scenic reserve and be amalgamated with the Whangamoa Scenic Reserve held in Gazette notice 257589.1.

(f) Require the Crown to contribute towards the cost of work on the fence, between the reserve land and the access land, in excess of the costs relating to an 8 wire fence, as described in the Second Schedule to the Fencing Act 1978.
