Electricity Industry Reform Act 1998

Notice of Exemption

The commission, pursuant to section 81, exempts Fletcher Challenge Limited and Fletcher Challenge Steel Limited from the application of section 17 of the Electricity Industry Reform Act 1998, in relation to a prohibited cross-involvement in an electricity lines business.

The exemption is subject to the following terms and conditions:

(a) That if FCL or any related company of FCL commences supplying line function services or electricity to other than another FCL related company FCL shall notify the commission.

(b) That if FCL or any related company of FCL commences electricity generation for other than its own consumption FCL shall notify the commission.

(c) That FCL and any related company of FCL shall advise the commission of any increased or new charge which comprises any component of the electricity price charged to any person provided with line function services or electricity.

(d) That FCL and any related company of FCL shall not introduce a charge to any of the consumers it supplies with electricity for the use of its electricity lines business.

(e) That should consumers currently supplied with line function services and electricity by FCL or its related companies wish to obtain electricity supplies from other electricity retailers, FCL and its related companies shall not prevent reasonable access to any of their electricity distribution networks by the retailers nor shall they require a use of system agreement for the use of any of their electricity distribution networks.

(f) That in order to comply with conditions (a) to (e) FCL shall conduct an annual audit of its related companies and report to the commission on the results of the audit. The first audit report shall be provided to the commission by 30 September 2000.

The commission may vary or revoke this exemption in accordance with section 81 (5) of the Electricity Industry Reform Act.

The exemption takes effect from the date of publication of this notice in the New Zealand Gazette.

Heavy Motor Vehicle Regulations 1974

Compliance of Bolster Attachments for Logging Bolsters on Trucks and Trailers Used for the Transport of Logs to the Bolster Attachment Code

Pursuant to regulation 16A (1) (f) of the Heavy Motor Vehicle Regulations 1974, and pursuant to powers sub-delegated to me by the Director of Land Transport Safety, I, Peter Waring, Senior Engineer, hereby determine that verification of compliance of bolster attachments to trucks and trailers used for the transport of logs, under the Code of Practice specified in Schedule 1, or any later edition of this code, will be by the use of a document in a form approved by the Director of Land Transport Safety.

Bolster Attachment Code (issue 27 November 1998) issued on behalf of the Log Transport Safety Committee.

The Traffic (Queenstown Lakes District) Notice 1999

Pursuant to sections 52 (1) and 52 (3) of the Transport Act 1962 and pursuant to an authority sub-delegated to me by the Land Transport Safety Authority of New Zealand dated 9 June 1997, I, John Paul Edgar, Manager, Safer Roads, give the following notice:

(1) This notice may be cited as the Traffic (Queenstown Lakes District) Notice 1999.

(2) The area specified in the Schedule is declared to be a closely populated locality at all times pursuant to section 52 (1) (c) of the Transport Act 1962.

(3) The Traffic (Lake County) Notice No. 1, 1985* is revoked.

Schedule

SITUATED within Queenstown Lakes District at Glenorchy:

All roads within an area bounded by a line commencing at the eastern end of Coll Street, and proceeding south-westerly generally by a right line to a point on the eastern side of Oban Street, 480 metres measured southerly generally along Oban Street from Coll Street; thence across Oban Street at right angles to its eastern side and along the prolongation of that line to the eastern shore of Lake Wakatipu; thence north-westerly generally along that lake shore to a point due west of the northern end of Oban Street; thence due east by a right line to the northern end of Oban Street; thence south-easterly generally by a right line to a point on the northern side of Mull Street, 130 metres measured easterly generally along Mull Street from Oban Street; thence across Mull Street at right angles to its northern side; thence easterly generally by a right line to the commencing point.
