Securities Amendment Act 1988

The Authorised Futures Dealers Notice (No. 6) 1999

Pursuant to section 38 of the Securities Amendment Act 1988, the Securities Commission gives the following notice.

Notice

1. Title and commencement—(1) This notice may be cited as the Authorised Futures Dealers Notice (No. 6) 1999.

(2) This notice comes into force on the day after the date of its publication in the New Zealand Gazette.

2. Interpretation—(1) In this notice, unless the context otherwise requires:

“Act” means the Securities Amendment Act 1988.

(2) Any term or expression that is not defined in this notice, but that is defined in the Act, has the meaning given to it by the Act.

3. Authorisation—(1) Douglas John Bowering of Glen Eden, Auckland, is authorised to carry on the business of dealing in futures contracts generally.

(2) The authorisation is subject to the conditions that Douglas Bowering:

(a) does not hold client money or client property in connection with futures contract dealing;

(b) does not enter into any futures contract as a principal on behalf of any client;

(c) does not carry on the business of dealing in futures contracts on behalf of any person other than one who has:

(i) entered into a contract for services with the company and then only in accordance with the terms of that contract; and

(ii) entered into a client agreement with a broker or dealer who is authorised or licensed by the laws of the country in which it operates to deal in futures contracts on behalf of that person and to hold client money for that purpose; and

(d) does not carry on the business of dealing in futures contracts on behalf of any person other than in relation to transactions effected through a broker or dealer referred to in paragraph (c) (ii); and

that the authorisation applies in respect of futures contracts made on or effected through a futures exchange in a country other than New Zealand which is authorised by the laws of that country to operate as a futures exchange.

(3) The authorisation expires on the close of 30 August 2004.

Reserves Act 1977

Amendment to a Notice—Revocation of the Reservation Over Part of a Reserve

Pursuant to section 6 (3) of the Reserves Act 1977, and to a delegation from the Minister of Conservation, the Community Relations Manager, for the Waikato Conservancy of the Department of Conservation, hereby amends an error in the notice dated the 3rd day of June 1999, and published in the New Zealand Gazette, No. 67, page 1551, by replacing reference to S.O. Plan 60210 with S.O. Plan 61210.

Corrigendum

Amending a Notice Classifying a Reserve

Pursuant to section 6 (3) of the Reserves Act 1977, and to a delegation from the Minister of Conservation, the Conservator, Canterbury, hereby amends the notice dated the 19th day of July 1999 and published in the New Zealand Gazette, No. 87, page 2093, by inserting in the description head ‘Schedule B’, immediately after the words “part Lot 1, D.P. 6339”, the words “and part Lot 4, D.P. 8344”.

Exchange of a Reserve for Other Land

Pursuant to the Reserves Act 1977, and to a delegation from the Minister of Conservation, the Community Relations Manager of the Auckland Conservancy of the Department of Conservation, hereby declares that the reserve, described in the First Schedule hereto, is hereby exchanged for the land described in the Second Schedule hereto.
