Civil Aviation Act 1990

Notice of Granting of an Open Aviation Market Licence and Variation of a Scheduled International Air Service Licence

Pursuant to sections 87U (4) and 87Q (4) of the Civil Aviation Act 1990 and a delegation from the Secretary for Transport dated 28 August 1996, I give notice that, having received an application from Singapore Airlines Limited, of Singapore, I have:

(a) granted that airline an Open Aviation Market Licence to carry on scheduled services and non-scheduled flights in accordance with the 27 November 1997 Air Services Agreement Between the Government of New Zealand and the Government of the Republic of Singapore, for an indefinite term with effect from 7 April 1998; and

(b) varied the Scheduled International Air Service Licence granted to that airline to provide for that licence to expire on 7 April 1998.

Under Sections 31 and 35 of the Civil Aviation Act 1990

The Director of Civil Aviation made an emergency rule on 5 March 1998, which prescribes requirements for Ardmore aerodrome traffic in addition to those prescribed in any other Civil Aviation Rule Part including general operating and flight rules prescribed in Part 91 and the special aerodrome traffic rules prescribed in Part 93 Subpart G when an aerodrome control service is not in operation. The rule is effective from 6 March 1998.

Copies of the emergency rule are available for viewing at the office of the Civil Aviation Authority, Aviation House, 1 Market Grove, Lower Hutt and on application to the Docket Clerk, P.O. Box 31-441, Lower Hutt.

Summary of Exemptions Granted by the Director of Civil Aviation

Pursuant to section 37 of the Civil Aviation Act 1990, notification is hereby given of exemptions, set out in the Schedule hereto, granted by the Director of Civil Aviation.

Nature of exemptions granted:

Docket 98/EXE/46, on 3 April 1998, the director granted an exemption to Air Nelson Limited, Air New Zealand Limited, Ansett New Zealand Limited, Eagle Airways Limited, Air Freight New Zealand Limited, Airwork New Zealand Limited, Freedom Air International, Mount Cook Airline Limited, and Origin Pacific Airways Limited from the requirement that they shall provide a technical log for each of their aircraft that has provision for recordingβ€”

(i) a statement of the maintenance status of the aircraft including the identity of the next scheduled inspection and the date due;

(ii) the date or hours at which any other maintenance is due prior to the next scheduled inspection;

(iii) the total time in service; and

(iv) the total cycles;

provided that Air Nelson Limited, Air New Zealand Limited, Ansett New Zealand Limited, Eagle Airways Limited, Air Freight New Zealand Limited, Airwork New Zealand Limited, Freedom Air International, Mount Cook Airline Limited, and Origin Pacific Airways Limited have a maintenance planning system thatβ€”

(i) is documented in their exposition;

(ii) is accepted by the director;

(iii) continually records, monitors, and reports the maintenance status of each of their aircraft carrying the abridged technical log; and

(iv) can make that maintenance status of each aircraft carrying the abridged technical log available to operating crew on request.

Docket 98/EXE/48, on 31 March 1998, the director granted an exemption to Mr S. C. Bicknell from the requirement to display markings in accordance with Rule 47.101 (a) with respect to his registered aeroplane ZK-AZR.

Docket 98/EXE/91, on 27 February 1998, the director granted an exemption to Mr W. J. Funnell, Mr E. W. Pratt and Mr J. C. Kirkland of Helicopter Services (BOP) Limited, from the requirement of Civil Aviation Rule 61.5 (c) only when acting as pilot-in-command of a Mi-8MTV-1 aircraft engaged on an operation for hire or reward; provided that:

(a) no operation for hire or reward carried out in a Mi-8MTV-1 aircraft by any of the said pilots involves the carriage of passengers; and

(b) the said pilot acting as pilot-in-command continues to:

(i) hold a Commercial Pilot Licence (Helicopter);

(ii) hold a type rating for a Mi-8MTV-1 aircraft;

(iii) comply with all the relevant provisions of the Civil Aviation Rules;
