NEW ZEALAND GAZETTE No. 53
Amending a Notice Acquiring Land for Soil Conservation and River Control Purposes in Thames-Coromandel District
Pursuant to section 55 of the Public Works Act 1981, the Minister of Lands, hereby amends the notice dated 10 December 1991, published in the New Zealand Gazette of 19 December 1991, No. 193 at page 3958, acquiring land for soil conservation and river control purposes in Thames-Coromandel District by:
(i) omitting the words “Section 20” and substituting the words “Sections 20 and 28”;
(ii) inserting the word “First” before the word “Schedule” twice appearing;
(iii) inserting after the word “Gazette” the words “subject to the right of way easement described in the Second Schedule hereto to be held over the land described in the First Schedule hereto to be held appurtenant to the land described in the Third Schedule hereto”; and
(iv) adding the following Second and Third Schedules.

The rights implied in and attaching to a right of way as set out in the Seventh Schedule of the Land Transfer Act 1952, as if the same were fully set out herein but excluding the rights implied in easements of vehicular right of way set out in the Ninth Schedule of the Property Law Act 1952.
Third Schedule
South Auckland Land District
Dominant Tenement
1,6330 hectares, being part Kaiwakawaka B1 Block and Sections 1 and 2, S.O. 58806. All certificate of title No. 11C/311.
1476 square metres, being part Kaiwakawaka B2A Block. All certificate of title No. 9C/794**.

Land Acquired for Soil Conservation and River Control Purposes in Thames-Coromandel District Subject to an Easement
Pursuant to sections 20 and 28 of the Public Works Act 1981, the Minister of Lands, declares that, an agreement to that effect having been entered into, the land described in the First Schedule hereto, is acquired for soil conservation and river control purposes and shall vest in The Waikato Regional Council on the date of publication hereof in the New Zealand Gazette, subject to the right of way easement described in the Second Schedule hereto, to be held over the land firstly described in the First Schedule hereto to be held appurtenant to the land described in the Third Schedule hereto.
