Amending a Notice Acquiring Land for Soil Conservation and River Control Purposes in Thames-Coromandel District

Pursuant to section 55 of the Public Works Act 1981, the Minister of Lands, hereby amends the notice dated 13 December 1991, published in the New Zealand Gazette of 19 December 1991, No. 193 at page 3959, acquiring land for soil conservation and river control purposes in Thames-Coromandel District by:

(i) omitting the words “Section 20” and substituting the words “Sections 20 and 28”;

(ii) inserting the word “First” before the word “Schedule” twice appearing;

(iii) inserting after the word “Gazette” the words “subject to the right of way easement described in the Second Schedule hereto to be held over the land firstly described in the First Schedule hereto to be held appurtenant to the land described in the Third Schedule hereto”; and

(iv) adding the following Second and Third Schedules.

Description of Easement
The rights and powers implied in and attaching to a right of way as set out in the Seventh Schedule of the Land Transfer Act 1952, as if the same were fully set out herein but excluding the rights implied in easements of vehicular right of way set out in the Ninth Schedule of the Property Law Act 1952.

Land at Main North Road, Woodend, Set Apart for Road

Pursuant to section 52 of the Public Works Act 1981, and to a delegation from the Minister of Lands, the Manager, Crown Property Services, Land Information New Zealand, Christchurch, declares the land described in the Schedule to be set apart for road which, pursuant to section 60 (2) of the Transit New Zealand Act 1989, shall form part of State Highway No. 1 and shall remain vested in the Crown.
