Declaration That Land is a Reserve

Pursuant to the Reserves Act 1977, and to a delegation from the Minister of Conservation, the Community Relations Manager of the Nelson/Marlborough Conservancy of the Department of Conservation, hereby notifies that the following resolution was passed by The Tasman District Council on the 5th day of March 1998:

“That in exercise of the powers conferred on it by section 14 of the Reserves Act 1977, The Tasman District Council hereby resolves that the piece of land held by the said council in fee simple and described in the Schedule hereto, shall be, and the same is hereby declared to be a local purpose (war memorial) reserve within the meaning of the said Act”.

1017 square metres, more or less, being part Lot 6, D.P. 657, situated in Block II, Moutere Survey District. All certificate of title 97/119.

Te Ture Whenua Maori Act 1993

Notice Redefining the Purposes of a Maori Reservation

Pursuant to section 338 (5) (c) of Te Ture Whenua Maori Act 1993, on the recommendation of the Maori Land Court, the purposes for which the Maori reservation in respect of the land described in the Schedule hereto, was created by notice published in the New Zealand Gazette, No. 59, page 1538 on the 20th day of September 1962, are hereby redefined as being for the purpose of a marae known as Kaitumutumu Marae for the common use and benefit of the Ngati Whawhakia subtribe of the Waikato tribes.

Pursuant to section 338 (5) (b) of Te Ture Whenua Maori Act 1993, on the recommendation of the Maori Land Court, the Maori freehold land described in the Schedule hereto, and published in the New Zealand Gazette, No. 25, page 652, dated 20 March 1997, is hereby cancelled.

Setting Apart Maori Freehold Land as a Maori Reservation

Pursuant to section 338 (1) of Te Ture Whenua Maori Act 1993, on the recommendation of the Maori Land Court, the Maori freehold land described in the Schedule hereto, is hereby set apart as a Maori reservation for the purpose of a urupa for the common use and benefit of the descendants of Te Whanau-A-Kouma Tapihana.

  1. The descendants of Te Whanau-A-Kouma Tapihana;

  2. The descendants of Ngatai Retireti.
