Declaration That Land is Reserve

Pursuant to the Reserves Act 1977, and to a delegation from the Minister of Conservation, the Conservator for the Auckland Conservancy of the Department of Conservation, hereby notifies that the following resolution concerning the parcels of land described in the First and Second Schedules hereto was passed by The Rodney District Council at its meeting on the 28th day of May 1998:

“That in exercise of the powers conferred on it by section 14 of the Reserves Act 1977, The Rodney District Council hereby resolves that the pieces of land held by the council in fee simple and described in the First Schedule hereto, shall be and the same is hereby declared to be reserves for recreation purposes and further, that the piece of land held by the council in fee simple and described in the Second Schedule hereto, shall be and the same is hereby declared to be a scenic reserve”.

First Schedule

North Auckland Land District—Rodney District

809 square metres, more or less, being Lot 53, D.P. 48144, situated in Block III, Kawau Survey District. Certificate of title 37A/139.

3.0723 square metres, more or less, being Lot 1, D.P. 37998, situated in Block VII, Mahurangi Survey District. Certificate of title 1002/70.

Second Schedule

North Auckland Land District—Rodney District

1454 square metres, more or less, being Allotment 135, Parish of Ahuroa, situated in Block IX, Mahurangi Survey District. Excepting pursuant to section 19 of the Public Works Act 1928, any mines of coal or other minerals not taken by Proclamation 2481. Certificate of title 28A/1421.

Classification of Reserve and Vesting in the Ototiki District Council

Pursuant to the Reserves Act 1977, and to a delegation from the Minister of Conservation, the Community Relations Manager, East Coast/Hawke’s Bay Conservancy, classifies the reserve, described in the Schedule, as a recreation reserve and vests the reserve in The Ototiki District Council in trust for that purpose.
