Pursuant to the Public Works Act 1981, and to a delegation from the Minister of Lands, Kerry John Twydle, Land Information New Zealand:

(a) Pursuant to section 114 (1), declares the land described in the First Schedule to this notice, to be acquired for road which, pursuant to section 60 (2) of the Transit New Zealand Act 1989, forms part of State Highway 12, and shall vest in the Crown on the date of publication hereof in the New Zealand Gazette.

(b) Pursuant to section 116, declares the road described in the Second Schedule to this notice, to be stopped.

Notice of Intention to Take Land

In the matter of section 23, Public Works Act 1981:

Notice is hereby given pursuant to section 23 (1) (b) of the Public Works Act 1981, that The Timaru District Council intend to take the land described in the Schedule hereto for road.

– The taking is considered reasonably necessary to enable the land to continue to be used as a public road to various properties in the commercial/retail area of Pleasant Point.

– Any person having an estate or interest in the land may within 20 working days after the date of this notice send an objection to The Registrar, Environment Court, care of Tribunals Division, P.O. Box 5027, Wellington. If any objection is made in accordance with this notice, a public hearing will be held, unless the objector otherwise requires, and each objector will be informed of the time and place of the hearing.

Schedule

All that piece of land known as “Morris Lane” Pleasant Point containing 593 square metres, being part Rural Section 2569 formerly contained in and being part of deed of conveyance 21922 (37D/19) and now being defined as Lot 1, Deposited Plan 69721 (Canterbury Registry).
