Sutherland, Land Information New Zealand, declares that, agreements to that effect having been entered into, rights to convey water over the land described in the First Schedule hereto, subject to the land firstly described, being subject to rights of way created by easement certificate D. 068332.6, and the land secondly described, being subject to electricity and telecommunications easements created by transfer D. 146727.6, containing the rights and powers as contained in the Second Schedule hereto, are acquired for irrigation purposes in perpetuity and shall vest in the Crown on the date of publication of this notice in the New Zealand Gazette.

An easement, 3 metres wide over part Lot 1, D.P. 174535; marked “A” on plan.

An easement, 3 metres wide over part Lot 2, D.P. 173208; marked “C” on plan.

Shown marked as above mentioned on D.P. Plan 188998, lodged in the office of the Chief Surveyor at Auckland.

Second Schedule

The rights and powers contained in the second and fourth paragraphs of the Seventh Schedule of the Land Transfer Act 1952, as modified by the additional terms and conditions described in the Agreements between Her Majesty the Queen and:

copies of which can be sighted on the LINZ file mentioned below, and copies of which will be registered against the said certificates of title along with this notice.

Amending a Notice Acquiring Land and Easements for Irrigation Purposes (Maungatapere Irrigation Scheme) Over Land in the Whangarei District

Pursuant to section 55 of the Public Works Act 1981, and to a delegation from the Minister of Lands, Kerry John Twydle, Land Information New Zealand, hereby amends the following notices, acquiring easements for irrigation purposes.

Dated 17 August 1998, published in the New Zealand Gazette of 27 August 1998, No. 125, at page 3042.

Dated 16 September 1998, published in the New Zealand Gazette of 24 September 1998, No. 157, at page 3786.

By deleting the following from the body of the notices referred to above:

“… are acquired for irrigation purposes for a term expiring on the 31st day of December 2050 …”

and substituting the following:

“… are acquired in perpetuity …”
