Service Lane Realignment in Otorohanga District

Pursuant to Part VIII of the Public Works Act 1981, the Minister of Lands:

(a) Pursuant to section 114, declares the land described in the First Schedule hereto to be service lane and vested in The Otorohanga District Council.

(b) Pursuant to section 116, declares the pieces of service lane described in the Second Schedule hereto, to be stopped.

(c) Pursuant to section 119, declares the land described in the Third Schedule hereto, to be taken.

(d) Pursuant to sections 117 and 119, declares that areas “C” and “D”, now known together as Section 2, S.O. 60596, and area “E”, now known as Section 1, S.O. 60596, shall be amalgamated with the land in certificate of title No. 58A/757, South Auckland Land Registry.

Land Acquired for Soil Conservation and River Control Purposes in Thames-Coromandel District Subject to a Right of Way Easement

Pursuant to sections 20 and 28 of the Public Works Act 1981, the Minister of Lands declares that, an agreement to that effect having been entered into, the land described in the First Schedule hereto, is hereby acquired for soil conservation and river control purposes and shall vest in The Waikato Regional Council on the date of publication hereof in the New Zealand Gazette, subject to the right of way easement described in the Second Schedule hereto, over the land fourthly and fifthly described in the First Schedule hereto, to be held appurtenant to the land described in the Third Schedule hereto.

Second Schedule

South Auckland Land District

The rights implied by and attaching to a right of way as set out in the Seventh Schedule of the Land Transfer Act 1952, as if the same were fully set out herein, provided that:

1. (7) The parties agree that the future maintenance of the easement is to be a shared responsibility in proportion to respective parties usage.

2. (8) Any dispute over the use, maintenance of the rights of way may be referred to a single arbitrator or if the parties are unable to agree as to the appointment of a single arbitrator then by reference to two arbitrators one appointed by each party and the resolution in terms of the Arbitration Act 1908 or its amendments.

Third Schedule

South Auckland Land District

31.0342 hectares, being part Okewa No. 3 Block, being all the land contained in certificate of title, Volume 286, folio 268.
