The Minister of Lands declares that, pursuant to section 20 of the Public Works Act 1981, an agreement to that effect having been entered into, the land described in the First Schedule hereto, is hereby acquired for sewage treatment purposes, and shall vest in The New Plymouth District Council on the date of publication of this declaration in the New Zealand Gazette, and pursuant to section 52 of the Public Works Act 1981, the lands described in the Second Schedule are hereby set apart for sewage treatment purposes and shall remain vested in The New Plymouth District Council.

Declaring Easement Over Land Acquired for Soil Conservation and River Control Purposes in Block II, Clive Survey District

Pursuant to section 20 of the Public Works Act 1981, and to a delegation from the Minister of Lands, the Crown Property Officer, Land Information New Zealand, Napier, declares an agreement to that effect having been entered into, the following easement in gross is acquired for soil conservation and river control purposes (and may be surrendered at any time by notice in the New Zealand Gazette) vesting in The Hawke’s Bay Regional Council (called the grantee) on the date of publication in the New Zealand Gazette, the right to construct a river stopbank including the full and free right in perpetuity for the grantee and its agents to do the following over the land described in the Schedule (called the land):

(a) to enter the land and to pass and repass at all times with or without machinery or vehicles;

(b) to modify, maintain or reconstruct the stopbank and to do all things necessary to maintain the same in an efficient state;

(c) to prohibit over grazing of the land and destruction or vegetation by fire or cultivation;

(d) to prohibit the planting of trees or crops (other planting may be undertaken with the approval of the grantee; such approval shall not be unreasonably withheld) on the land;

(e) to prohibit the erection of any building on the land; and

(f) to exercise the within rights in a manner reasonably necessary to serve the purpose of the work.
